Dear Dan:
As I indicated in my last Status Report to you, the three above-referenced
related Land Court cases involving the Town of Yarmouth ZBA as a party, have
been settled between the two residential land owners, the Sheas and Dr.
Marasco.
I have signed a Stipulation of Dismissal with prejudice in the three cases
which has been filed with the Land Court by Attorney Kirk, formerly closing
those cases. Copies of these Stipulations were sent to you on September 11,
2018.
Enclosed for your reference is a copy of the transmittal letter to the Land
Court by Attorney Kirk, dated September 14, 2018 filing the Stipulations.
I have also included for your file a copy of Attorney Kirk' s cover letter to
counsel and a copy of the Owner' s Agreement settling the cases, which was
recorded in the Barnstable County Registry of Deeds on September 14, 2018 .
All fourteen (14) owners of the residential lots in the Bass River Park
Subdivision have signed the Agreement for the purpose of clarifying their
rights, duties and obligations as owners.

Please see Section IV of the Agreement which relates to Lot 3A, owned by Dr.
Marasco, the subject of the Land Court actions brought by the Sheas and the
December 1, 2011 Yarmouth ZBA' s grant of a variance, approving a two family
dwelling on Lot 3A after Dr. Marasco had been granted a building permit in
2006 authorizing the construction of a three-car garage attached to his
principal residence on Lot 3A. This Settlement Agreement recognizes one
exception to the lot Owner' s Agreement. Otherwise each lot in the
subdivision shall only be used for purposes of a single family residence nor
shall any lot or structure located thereon be the "site or location of a
condominium or cooperative form of ownership..."
The exception set forth in Section IV involving Marsasco' s Lot states that,
"Lot 3A is now the site of a lawfully permitted two family dwelling..."
Please let me know if you have any questions. Otherwise, this now concludes
this matter that I have handled for the Town and I want to thank you for the
business.
I have enclosed my final bill for professional services and costs.
It has been a pleasure dealing with you. Let me know if I can do anything
further for you in the future.

WHEREAS the deeds conveying each undivided one-fifteenth(1/15th) part of the River Parcel
also contain the following language:
•
"..it being expressly agreed and understood that the owner of each numbered lot on such plan is
. to assume and pay one fifteenth part of the taxes on said Second Parcel and one fifteenth part of
the upkeep and repair said pier and float."
WHEREAS there was recorded at Bamstable County Registry of Deeds at Plan Book 137,
Page 57 a plan entitled: "Plan of Land in Bass River,Yarmouth,Mass., for Buena C. Brewer"
("the Brewer Plan")which plan was a modification of Lots 5, 6 and 7,as shown on the Bass
River Park Plan, and which modification created new lots designated on said Brewer plan
as Lots 1, 2 and 3; and
WHEREAS Lots I and 2 as shown on the Brewer plan(formerly Lots 6 and 7 as shown on the
Bass River Park plan)have now merged into one lot at 180 River Street containing .87 acres,
with the result that there are now(14)fourteen residential lots, each with equal ownership,rights
responsibilities and obligations with respect to the River Parcel ; and
WHEREAS ,the fourteen(14) Owners of all the lots and land shown on the various plans as
above described wish to clarify and confirm their rights, duties and obligations arising out of
their ownership of the (now) fourteen(14)residential lots contained in the Bass River Park
subdivision,and to clarify and confirm their rights, duties and obligation arising out of the
corresponding appurtenant rights and obligations with respect to the River Parcel
NOW THEREFORE,in consideration of the payment of Ten($10.00)Dollars by each of the
undersigned Owners to each other Owners,receipt of which is hereby acknowledged by said
Owners, and in consideration of the covenants,agreements and representations contained herein,
each undersigned Owner does hereby agree to the following:

The Owners,individually and collectively hereby agree that no lot or land shown on the Bass
River Park Plans,nor any structure located thereon, shall be the site or location of a
condominium or cooperative form of ownership whereby any portion of such lot, land or
structure may be in ownership separate from the ownership of the whole of such lot,land or
structure.
SECTION IV
Lot 3A
On or about December 19,2006 the Building Department of the Town of Yarmouth issued a
permit authorizing the construction of a three-car garage attached to the principal residence on
Lot 3A. The permit included approval of an apartment on the second floor of the garage.
On or about March of 2009,the owner of Lot 3A applied to the Yarmouth Zoning Board of
Appeals for a variance from the provision of the Yarmouth zoning bylaw which would authorize
the use of the apartment as a second dwelling unit in a two family dwelling.In a decision filed
with the Yarmouth Town Clerk on December 1,2011 the Yarmouth Zoning Board of Appeals
granted the requested variance, thereby approving a two family dwelling on Lot 3A.
In Land Court Misc Case No. 457215, abutters to the premises appealed the decision granting the
variance(Count I) and also sought a declaration(Count II) from the Land Court that certain
recorded private restrictions prohibited any lot shown on the Bass River Park plans from
being used for any purpose other than as the site of a single family dwelling.
