TOWN OF YARMOUTH BOARD OF APPEALS Filed with Town Clerk: Hearing Date : June 22 , 1978 JUL 1 Q 1978 Petition No. 1495 Petitioner: Jack J. Furman, 180 River View Lane, Centerville, Massachusetts DECISION The petitioner requested permit to : allow construction in a residential RD-4 District of an additional 10 motel_ units in an existing motel in an area previously used as a restaur- ant and lounge. Premises are known as Windjammer Econo-Lodge, Located on South Shore Drive, South Yarmouth, Mass. , and shown as Loq 13 and an unnumbered parcel on Assessors map No. 15-L1. Members of Board of Appeals present : Thomas N. George, Donald F. Henderson, John Neylon, David Oman, Herbert Renkainen . It appearing that notice of said hearing has been given by sending notice thereof to the petitioner and all those owners of property deemed by the Board to be affected thereby, and that public notice of such hearing having been given by pub- lication in the Cape Cod Times on June 5 and June 12, 1978, the hearing was opened and held on the date first above written. The following appeared in favor of the petition : Jack J. Furman Kay Snowden, Manager The following appeared in opposition: Elizabeth Galinaro John Newton, Town Engineer Reason for decision : The Board believes the area will not be affected by the additional ten rooms requested. The petitioner has tried to make his restaurant and lounge work profitably but he cannot generate sufficient business to overcome losses so he has a hardship. ls Petitioner indicated there will be no increase in the dimensions of the buildings. The only exterior change is to be facade. There is ample parking based on the by-law formula. The Board voted approval with the provisions : :AZ :- 1. The permit is not to issue until the water drainage problem presently existing (drainage being pumped onto adjacent town property) is corrected. ✓ 2. All drainage of any kind and for all reasons is to be contained on locus. 3. The septic system to be installed or hooked into_is to conform to all current code-requirements. v 4. The eleven parking spaces required for the ten new units are to conform to current parking standards es- tablished by the Town by-law. Members of the Board voting: Thomas N. George , Donald F. Henderson, John Neylon, David Oman, Herbert Renkainen. Therefore the Petition for Approval is granted, subject to the above conditions.
