Robinson Street Third Floor Norman, OK 73072 Re: 241 Willow Street West Yarmouth, MA Dear Mr. Enriquez: As per your request of November 8 2018 for zoning and Code related issues concerning 241 Willow Street West Yarmouth,please be advised of the following: Zoning Compliance/Verification -The property in question lies within the Town of Yarmouth Zoning B-3 Industrial Zoning District and the Aquifer Protection District -The dba name is Cape Cod Artificial Kidney Center. -The existing use is identified as 08, Professional Office as per Zoning Bylaw Table 202.5 -This use is allowed by right in the B-3 District and by Special Permit from the Zoning Board of Appeals in the Aquifer Protection District. -The Aquifer Protection District zoning provision was adopted April 11, 1989. According to our records,a Certificate of Occupancy was issued for this use on February 22, 1977. Adjacent Property Use -235 Willow Street---dba name is Bio Medical Application CC, Inc. -247 Willow Street---dba name is Cape&Islands Council, Boy Scouts of America(office) -26 Summer Street---dba name is IFAW Zoning Board of Appeals Special Permits -Petition No. 1830, Special Permit issued April 29, 1982 for an addition and to reduce the parking increase triggered by the addition. -Petition No. 2389, Special Permit issued February 11, 1986 for an addition and storage area. The Board of Appeals required a plan showing two lots being combined. -Petition No. 3459, Special Permit issued March 25, 1998 for an addition and to expand parking Page 2 ---241 Willow Street J. Code Violations -To the best of my knowledge there are no outstanding Building Code or Zoning violations. -In terms of Fire Code violations, the Yarmouth Fire Department will have to provide you that information. -Our records show that a Wiring Permit was issued on September 26, 2017 for a water heather replacement. The electrician failed to request an inspection, and therefore the new devise from an electrical standpoint was not approved. Certificate of Occupancy -As noted above,our records show that the original Certificate of Occupancy was issued February 22, 1977 (copy enclosed) -The annual Certificate of Inspection required pursuant to 780CMR,State Building Code,Section 106.5 was issued February 26, 2018 and will expire one year from that date. Site Plan Approval -The site is not located in a Planned Develop area. -The original site plants not available. -Site Plans were submitted to the Zoning Board of Appeals for the Petitions noted above.
