Yarmouth, MA 02664 RE: South Yarmouth Library Dear Mr. Crista At its meeting of December 10, 1979, the Architectural Barriers Board reviewed a request for an advisory opinion and a request for a variance submitted in behalf of the above named premises. With respect to the requested advisory opinion,,' the Board finds that this building is considered a library, and as such, open to and used by the public, therefore, it is under the jurisdiction of these Regulations. Although the place of assembly in the basement would not be a place of assembly under Section 19, it should still be accessible according to the Regulations, whether or not it is appropriate to the variance. Findings and Decision After hearing, a majority of Board members having heard the evidence and having voted thereon, the Board hereby finds and decides as follows : On Issue 1, the Board finds : The hoard finds that the basement of this facility is used for a plate of assembly, it is open to and used by the public, there is an outside staircase, and it is presently inaccessible. The Board agrees that installing an elevator would be impractical. The petitioners will explore the possibility of installing a wheelchair lift. • On Issue 2, the Board finds : Same as above. • • A variance is therefore granted for the following . • reason: Granted to Sections 4.11-.2 and 14 for the reason that the petitioners have made an attempt. to explore the possibility ;, • of providing accessibility and that they will continue to do so. .VICER1D SXMIX§ifliM 1fiX ' `OWerda .clOWO D2Ritti4XXIMITIMIXI O{ THIS VARIANCE IS GRANTED FOR A TERM OF ONE YEAR. • • • See attached pages for decisions on other issues. This constitutes a final decisino of the Architectural Barriers Board entered pursuant to GcL. c. 30A. Any aggrieved person may appeal this decision to the Superior Court of the Commonwealth of Massachusetts pursuant to Section 14 of G.L. c. 30A.
