DECISION
The petitioner requested permit to: a yartance and/QX. Ap 'QYa] QR. the
Board of Appeals to allow an addition of a porch roof and slab on existing
building which is under an existing variance granted 8/5/71. Property
located at 39 Webbers Path, West Yarmouth, Mass. and shown on assessors
Map #66-K78.
Members of the Board of Appeals present: Sherman, Henderson, Oman,
Renkainen and George.
It appearing that notice of said hearing has been given by sending
notice thereof to the petitioner and all those owners of property deemed
by the Board to be affected thereby and that public notice of such hearing
having been given by publication in the Cape Cod Times on February 13, 1980
and February 20, 1980, the hearing was opened and held on the date first
above written.
The following appeared in favor of the petition: Craig Ashworth
The following appeared in opposition: NONE
Reason for decision: This is a non-conformfing use existing by decision
of this board in case #1053 of August 5, 1971. The extention requested
would not infringe upon the public or the use thereof would not create
a nuisance or public ha7a.rd. The septic area is still protected and this
would not create excessive noise:
Members of the Board voting: Unanious vote
Therefore, the petition for varianc= , approval or special permit is •
granted.
No permit issued until 20 days from date of filing decision with the
Town Clerk.
