Notice of the hearing has been given by sending notice thereof to the Petitioner and all those owners
of property as required by law, and to the public by posting notice of the hearing and publishing in
The Register,the hearing opened and held on the date stated above.
The Petitioner seeks a Special Permit pursuant to Zoning Bylaw §104.3.2, in order to raze a legally
pre-existing non-conforming single family dwelling and replace it with a two story single family
dwelling. The Property is located in the R25 Zoning District and is improved with a one story
single family structure having 2 bedrooms and 1 bath, and constructed in approximately 1950.
The lot contains approximately 5,981 square feet. There is also a shed on the property which
will remain, but be relocated during construction of the new 3 bedroom septic system. The
existing house encroaches into the front yard setback by 6 inches, encroaches into the right side
setback by 1 '/x feet, into the left side setback by 5 1 feet, but complies with the rear setback.
The house height measures approximately 14 feet from the top of the foundation. The driveway,
serving the property, which can accommodate 2 vehicles,is a shared driveway with the abutter to
the northeast. Building Coverage is currently listed at 12.5%.
The proposal is to remove the existing structure, and to construct a two story single family
dwelling, containing 3 bedrooms and 2 baths. The structure is being positioned so that it
complies with the front yard setback. The left side encroachment into the setback will be
improved by 'h foot, and the right side encroachment will be improved by a few inches. The
proposed height of the building to the ridge will be 26.5 feet from the top of foundation,still well
below .what is permitted. A new Title 5 compliant septic system will be installed for 3
bedrooms. The building coverage will increase to 22.2%.

Several letters in support of the project were submitted. The direct abutter to the northeast
appeared in opposition and argued that the proposed structure would affect his views, his light,
his privacy, and that the project would not be in keeping with the neighborhood. The Board had
extensive discussion regarding these matters, and discussion centered on the role of the Board of
Appeals, the language of the Zoning Bylaw, and the appropriateness of this structure versus the
potential structure which could be constructed by right. In particular, discussion was had
regarding whether the fact that the property was being increased in height at all was in and of
itself an expansion of the pre-existing non conformity. The Board eventually resolved that the
Yarmouth Zoning Bylaw was not designed to prevent an increase in height, but rather, to
determine if that height, among other factors, was substantially more detrimental to the
neighborhood, zoning district or Town. The conclusion was that in this case, the proposal was
modest in nature, was fitting with the other properties in the neighborhood, and was potentially a
model for other properties on lots of similar size.
The Board was in unanimous agreement that the raze and replacement of the existing structure
would not be substantially more detrimental to the neighborhood, zoning district, or Town, than
the existing non-conforming structure. It was also noted that many of the homes in this
particular neighborhood have been allowed to increase to include second stories, including the
home of the objecting abutter, and that the Petitioner's property height would be consistent with
other homes in the neighborhood. Further, the Board found that the relief sought would cause no
undue nuisance, traffic or congestion to the existing or future character of the neighborhood or
Town.
Accordingly, a Motion was made by Mr. Igoe, seconded by Mr. Nickinello, to grant the Special
Permit, as requested, with the condition that the Yarmouth Board of Health approves a new Title
5 Septic System to accommodate the number of bedrooms proposed. The members voted
unanimously in favor of the Motion.
No permit shall issue until 20 days from the filing of this decision with the Town Clerk. Appeals
from this decision shall be made pursuant to MGL c40A section 17 and must be filed within 20
days after filing of this notice/decision with the Town Clerk. Unless otherwise provided herein,
the Special Permit shall lapse if a substantial use thereof has not begun within 24 months. (See
bylaw §103.2.5,MGL c40A §9)

The Board of Appeals also calls to the attention of the owner or applicant that General Laws,
Chapter 40A, Section 11 (last paragraph) and Section 13, provides that no Special Permit, or any
extension, modification or renewal thereof, shall take effect until a copy of the decision bearing
the certification of the Town Clerk that twenty(20) days have elapsed after the decision has been
filed in the office of the Town Clerk and no appeal has been filed or that, if such appeal has been
filed,that it has been dismissed or denied, is recorded in the Registry of Deeds for the county and
district in which the land is located and indexed in the grantor index under the name of the owner
of record or is recorded and noted on the owner's certificate of title. The fee for such recording

The Health Department file indicates an existing Pre-1995 Title 5 septic system with a grandfathered
design capacity of 2 Bedrooms total servicing the current dwelling. The property is not located within
the Zone II, and is therefore, not restricted to number of bedrooms based on the square footage of
the lot. The Health Department has witnessed suitable soil and percolation tests on August 8, 2018
for the proposed septic system upgrade for the proposed dwelling. Full review of the proposed
project, including the proposed septic system design, by the Health Department will be required prior
to final approval.

Hello,
We are writing in regards to the impending home addition plans of Dermot and Ann Marie Walsh on Lewis
Road in West Yarmouth. We have been neighbors of the Walsh's for 15 years, and have always found them to
be great contributors to the neighborhood. Their current"cottage" is well designed and maintained and one of
the nicest on the street. Any remodel they would undertake (and I have seen the plans so am speaking first
hand)would be just as aesthetically pleasing and keep with the architecture in the area.
We understand first hand ourselves the need to increase the square footage of our properties in order to
accommodate growing families. We would prefer to keep great neighbors,with great taste, in the area, rather
than see them go elsewhere on the Cape.
