The Petitioners are Thomas Kerr and Gail Kerr who have a primary residence at 20 Whippoorwill
Ln.,Yarmouth Port,MA.This application relates to a summer cottage which they own and which
is located at 39 Grace Ave., West Yarmouth, MA. This property is commonly known as the
Yarmouth Camp Grounds and is an area in which any change to the size of structures requires
zoning relief.The property is located in an R-40 Zoning District. The applicants seek to construct
in addition to a portion of this summer cottage.
The Petitioners did a fine job in describing their Petition and were benefited by the presence of
their builder, Dave Adams. The prospective project involves minor extensions of an ell off the
main cabin which will accommodate better use of the property. The Yarmouth Camp Grounds
Association approved the project prior to the presentation before the Zoning Board.
The Board felt that the Petitioners did a fine job in demonstrating that no undue hazard, nuisance
nor congestion would occur as result of the grant of a Special Permit nor would such relief cause
any substantial detriment to the existing or future character of the neighborhood or Town.

Accordingly, a Motion was made by Mr. Neitz, seconded by Mr. Nickinello to grant the Special
Permit without conditions.On this Motion the Board voted unanimously in favor.
No permit shall issue until 20 days from the filing of this decision with the Town Clerk. This decision
must be recorded at the Registry of Deeds and a copy forwarded to the Board of Appeals. Appeals
from this decision shall be made pursuant to MGL c40A section 17 and must be filed within 20 days
after filing of this notice/decision with the Town Clerk. Unless otherwise provided herein,the Special
Permit shall lapse if a substantial use thereof has not begun within 24 months.(See bylaw,MGL c40A
§9)

and correct copy of its decision granting said Special Permit, and copies of said decision,and of
all plans referred to in the decision,have been filed.
The Board of Appeals also calls to the attention of the owner or applicant that General Laws,
Chapter 40A,Section 11 (last paragraph)and Section 13,provides that no Special Permit,or any
extension, modification or renewal thereof, shall take effect until a copy of the decision bearing
the certification of the Town Clerk that twenty(20)days have elapsed after the decision has been

Dear Tom and Gayle,
This note is to inform you that the YCGA Board of Directors has approved your request to build
(at 39 Grace Avenue)an additional 10' x 12' extension to the existing enclosed porch and to
build a 7' x 9' bathroom to the front of the cottage,both as indicated in the blueprints you
provided.
Your request was approved by the board on September 8,2018 with the following stipulations:
1.) Any damage done from trucks during construction will be the responsibility of the home
owner.
2.) If there is a significant design change,the home owner must reapply to the board for
approval.
3.) Any debris resulting from the project must be removed from the grounds at the home
owner's expense.
4.) The home owner will abide by YCGA Standing Rules Section I, item 11: "...no
excavation or major construction or reconstruction shall be started between July 1 and
Labor Day.All excavations shall be filled and foundations capped,and heavy
construction equipment removed from the campground before July 1." '
A condition of this approval also requires that you or your agent obtain the necessary permits
from the Town of Yarmouth and that the project conform to all town regulations and codes. You
should also provide the clerk with a copy of the permit and a copy of your agent's liability
insurance coverage before the project begins.

Dear Members of the YCGA Board of Directors,
Gayle and I are writing to request your approval of the plan to extend our existing sun
room and build a new bathroom. Mr.David Adams has developed the plans for your
consideration and action. We are fully aware that you,as the Board,have full authority to either
approve,modify,or deny this request and we hope you will support this project. If you have
questions that need to be addressed during the meeting please feel free to contact us at 508-367-
4787.
We have contacted all of our abutters and have had direct positive responses from Dick
Bush and Andrew Kerr. We have asked the other abutters to contact us if they have any
questions or issues and have had no questions or concerns raised thus far to us. Vanessa Schnell
was not able to be contacted either by phone or by email.
The requested extension to our sunroom and the addition of a bathroom and small entry
porch are detailed in the plans Mr.Adams has developed for us. We have tried to make minimal
changes to the existing structure and the surrounding grounds. David Adams built this cottage
and has taken great pride in developing these new plans. It is our intention to seek three
independent bids for the work but use David's plans and fully expect him to be one of the three
bidders.

this request.

Dear Neighbors,
Gayle and I would like to inform you we are asking the Board of Directors
of the YCGA to approve two changes to our existing cottage at 39 Grace Ave. We
are asking their approval to add a 10'x 12' extension to the existing enclosed porch
and a 7'x 9' bathroom to the front of the cottage off the front of the enclosed
porch.
Our intention would be to begin this project this Fall/Winter but know
various approvals are required including meeting with the town officials.
We are attaching a picture of the plan David Adams is preparing for us and
we hope you can see this will be making minimal changes to our cottage and to the
grounds. This will be sent to you as a separate email.
Because the Board has the authority to approve this plan, or ask for
modifications, or deny it altogether, we want to notify you of our intention and to
ask you to send your comments or concerns directly to them by this Saturday,

REVISED COMMENTS 10/23/18:
PETITION #4777: 39 Grace Avenue, Thomas & Gayle Kerr, West Yarmouth
Upon receipt of additional information regarding the above petition, the Health Department file does
currently contain a septic system As-Built of a 1977 Title 5 septic system servicing the existing
dwelling. The septic system is grandfathered for the current number of bedrooms within the
dwelling. The location of the septic components to the rear of the property will not interfere with the
proposed addition. Full review of the proposed project, including submittal of a site plan identifying
the current location of the septic system in relationship to the dwelling and a complete floor plan
labelling type of rooms, will be required prior to final approval by the Health Department.
