The petitioner requested permit to: allow construction of a 16 ' x 31'
inground pool 16 feet from street line.
Members of Board of Appeals present : George, Sherman, Henderson,
Renkainan and Murphy.
It appearing that notice of said hearing has been given by sending
notice thereof to the petitioner and all those owners of property
deemed by the Board to be affected thereby and that public notice of
such hearing having been given by publication in the Cape Cod Times
on 5/28/80 and 6/4/80 , the hearing was opened
and held on the date first above written.
The following appeared in favor of the petition: Petitioner and
- Robert McLaughlin
•
The following- appeared in opposition: Rosaland Gruber, by telephone.
Reason for decision: This is not a use which would obstruct a
vehicles view, the fence is already in existance. The placement Of
- the septic system makes the lot such that this is the only
logical placement of the pool without creating the hardship of
relocation of septic to the front yard. This is a well established
neighborhood and this variance would not be detrimental .
Members of Board voting: Sherman, George, Henderson, Renkainan and
Murphy.
Therefore, the petition for variance, approval or special permit
is: granted.
