Dear Selectman Board of Appeals I am responding to a letter is the building departments comment I am in
violation of a signed code that was a established well after the store was built.These signs have been a
fixture in front of Hallet's Store for over 70 years.
I sent one letter to Tim Sears and had no response letter in close I requested a hearing does you a
violation says I'm entitled to one,I requested one in the second letter to the building apartment letter
enclosed.
I also sent copies of people signing the petition saying the sign has been in front of Hallet's store.
Mark Grylls Send me an application I'm not applying for a new sign these signs are existing they are a part
of Hallet's Store for decades.

I am requesting so right to a hearing on this matter Mark Grylls has not fulfilled my request so now I'm
requesting the selectmen/and the town Board of appeals.

Dear TIM SEARS
Hallet's Store has been established in 1889 there are no temporary signs these signs have been a fixture of
Hallet store for probably more than 80 years. If you check your records was discuss with the building
department and approved years ago Grandfathered laws.
We can submit thousands of photos that people have been taking pictures and several years of
advertising shows these same signs for years nothing has changed just the people that complain.
I have use the same signs for probably 35 years. Repaired the top sign three times in the last five years.
These are probably the most attractive signs A long 6A and not plastic or cardboard I understand your

I can't believe the building department is trying to use a new by law on old business that could not
conform to any of the new codes or sign codes written today that's why we have grandfather law.
303. SIGNS.
303.1 Goals and purposes—To regulate signage though a mechanism which protects and
serves the individual and economic interests of residents and businesses while at the same time
respecting community character, architectural design, and public safety.
No sign shall be erected nor maintained except as specifically allowed in this section.

303.5.7 Menu and Directory Signs. One (1) sign which displays a restaurant's menu or which
lists the businesses which are located within a building will be allowed in addition to any other
signs allowed by this zoning bylaw. This type of sign must be attached to the exterior of the
building and be located in close proximity to the main entrance of the restaurant or building.
This type of sign will not exceed three (3) square feet in size. This type of sign will not require
permits or fees.
Attached is the(petition)that I've had customers signing saying along the signs have been apart of the
business these bylaws were written well after the store was established 1889 being the most historical
Store on the Cape Cod I have established that these signs are not temporary and so have my customers.
Building department will cease any violation until I have a hearing to determine if I violated any codes or
laws. The signs will remain as they have 35 years I am asking protection under your sign code 303.1

Dear Mr. Clark,
It has come to the attention of the Building Department that temporary signs have been placed on this property without the
benefit of the proper permits. This is a violation of Section 303.4.1.2 of the Town of Yarmouth Zoning Bylaw;
303.4.1.2 Commercial.A business will be allowed not more than one additional temporary sign annually for the purpose
of advertising a grand opening, anniversary sale, or other special event. Signs which exceed eighteen (18)square feet in
area will not be allowed. Temporary signs may be displayed for up to fourteen (14)consecutive days and may apply for
one renewal. The location of temporary signs must be approved by the Building Commissioner. A permit from the Building
Commissioner is required and a fee will be charged.
Failure to comply with the provisions of the zoning bylaw may result in penalties as prescribed.
303.11.2 Fines for Permanent and Temporary Signs.Any violator of any of the provisions of this bylaw will be given
three (3) business days for correction of the defect or removal of the offending permanent sign, and one (1)working day
for correction of the defect or removal of an offending temporary sign. If correction is not made in the allowed time, the
owner will be finedff y dollars ($50)per day for the first seven (7)days and two hundredff y dollars ($250)per day
thereafter. Violations of display of signs will be cumulative with consecutive violations accruing fines as outlined above.
To remedy this alleged violation make proper application for the required permits,and receive the proper permits for these
violations.

Hallet's Store has been established in 1889 there are no temporary signs these signs have been a fixture of
Hallet store for probably more than 80 years. If you check your records was discuss with the building
department and approved years ago Grandfathered laws.
We can submit thousands of photos that people have been taking pictures and several years of
advertising shows these same signs for years nothing has changed just the people that complain.
I have use the same signs for probably 35 years. Repaired the top sign three times in the last five years.
These are probably the most attractive signs A long 6A and not plastic or cardboard I understand your

Dear Mr. Grills,
I am writing concerning the Town's policy,as discussed in the Cape Cod Times article about
Hallett's on August 4'", that can only be described as and-business.
Granted, the route GA corridor is historic, quaint, and beautiful and should be protected. But look to
our east and west at Dennis village and Barnstable village. Both towns'business districts retain their
quaint and attractive natures,but they are thriving in a way that Yarmouth Port is not.
Charles Clark's effort to maintain his small,historic business on route GA should not be thwarted by
a blind adherence to a rule. Surely this ruling could be modified,or an exception could be granted.
It's not like someone wants to put up a 20 foot high neon sign or build a big box store on route 6A.
What is the harm in allowing one (or two,three or four!) small A frame signs on route GA in
Yarmouth Port in an effort to make this section of town more vibrant,interesting and attractive to
tourists?After all,the Cape is a tourist based economy.
I sincerely hope you and the Building Commission will take a more reasonable and constructive
approach to this situation.

Attached is a copy of paperwork that was dropped off at the Clerk's Office. Mr. Clark advised
that he has been getting tickets daily from the inspector,whose name I cannot read on the ticket.
He plans to bring all the tickets to the Courthouse as soon as he can. I called Marcia to get the
original tickets but was advised that they have not been turned in.
I am wondering if this is a matter that can be handled short of a Magistrate Hearing if this sign
was grandfathered in as Mr. Clark states. Please let me know.
