Chapter 135 of the Acts of 2006 of the Massachusetts General Laws significantly altered
governmental oversight of massage therapy. Municipalities no longer have direct oversight of
massage therapists, massage facilities, or massage schools. However, local authorities do retain
sole jurisdiction over some"body work" practitioners specifically excluded from the new law.
The Board of Registation of Massage Therapy was not appointed until recently. Without a
Board, regulations could not be promulgated, and the Division of Professional Licensure could
not issue licenses or assume responsibility over inspection and enforcement. Without a viable
alternative, municipalites have continued oversight despite a nebulous legal situation.
Regulations are now promulgated and individual applications are being accepted. Business and
school application procedures will be announced at a later date. This means that municipalities
should stop issuing licenses to massage therapists. However, files or other historical documents
should be retained since one method of obtaining a Commonwealth license will be to
demonstrate the issuance of a municipal license. If possible, DPL would like an electronic copy
of your license files. We will use this for verification and to generate a mailing list of
prospective applicants. Additionally, the Board would like to know about any "problematic"
license holders in your jurisdiction.

Local boards of health may regulate fields not licensed as Massage Therapy.
The rules and regulations regarding Massage Therapy do not prevent or restrict the practice of a person who use
words, or directed movement to deepen awareness of patterns of movement in the body, or the affectation of the
energy system or acupoints or Qi meridians of the human body. Such practices shall include, but not be limited t(

• Ayurvedic Therapies
• Rolf Structural Integration
• Polarity; Polarity Therapy, or Polarity Therapy Bodywork
• Asian Bodywork Therapy that does not constitute massage

Shiatsu
• Body -Mind Centering

These exempt practitioners may use the terms "bodywork","bodyworker" and "bodywork therapist" in their prom(

RE: Preemption of local boards of health from licensing and regulating
massage therapists under M.G.L. c.14o, § 51
Dear Municipal Health Authority:
It has come to the attention of the Division of Professional Licensure ("DPL") and the Board of
Registration of Massage Therapy ("the Board") that there is some confusion among several of the
local boards of health regarding the applicability of the recently enacted massage therapy statutes to
the cities' and towns' abilitiesto license and regulate massage therapists. As the General Counsel of
the DPL, I am writing this letter to clarify and reiterate the DPL's and the Board's position that local
boards may no longer grant licenses and/or regulate the massage therapy field pursuant to M.G.L. c.
140, § 51. Under new legislation enacted in 2oo6, local boards of health are now preempted from
licensing and regulating massage therapists.
On June 27, 2oo6, the State Legislature enacted Chapter 135 Of the Acts of 20o6, "An Act Relative to
the Licensure of Massage Therapists." This legislation amended M.G.L. c.13 to add two new
sections, sections 98 and 99. M.G.L. c.13, § 98 creates the new state Massage Therapy Board.
M.G.L. c. 13, § 99 provides the Board with the following exclusive powers and duties:
"...to administer and enforce sections 227 to 236, inclusive, of chapter 112; (ii) to
adopt rules and regulations governing the licensure of massage
therapists, the practice of massage therapy and the operation of
massage schools to promote the public health, welfare and sgfety of
citizens of the commonwealth; (iii) to establish standards of professional and
ethical conduct; (iv) to establish standards for continuing education reflecting
acceptable national standards; and (v) to investigate complaints, conduct inspections,
review billing and treatment records and set and administer penalties as defined in
sections 61 to 65E,, inclusive, and sections 232 to 236, inclusive, of chapter 112 for
fraudulent, deceptive or professionally incompetent and unsafe practices and for
violations of rules and regulations promulgated by the board."
Prior to the enactment of Chapter 135 of the Acts of 20o6, the boards of health were given express
authority to regulate and license the massage therapists and the massage therapy establishments
located in their respective cities and towns under M.G.L. c.140, § 51. Specifically, M.G.L. c.140, § 51
stated that "No person shall practice massage ... or advertise or hold himself out as being engaged in
the business of massage —without receiving a license therefore from the board of health of the town
where said occupation is to be carried on..." Chapter 135 of the Acts of 20o6, however, amended
M.G.L. c.14o, § 51 by striking out the above referenced language and replacing it with express
language that "No person shall practice massage therapy unless licensed in accordance
with sections 227 to 236, inclusive, of chapter 112." The statute further states that "Local
boards of health may regulate other fields not licensed as massage the ranv under said
sections 227 to 236, inclusive, of said chapter 112."

Given the unambiguous language of Chapter 135 of the Acts of 2oo6, it is clear that the state
Legislature intended to create a uniform system of licensure and regulation of massage therapists
throughout the Commonwealth to replace the existing system of regulation that differs from town to
town. Consequently, by the clear terms of Chapter 135 of the Acts of 20o6, the state has expressly
preempted the field of licensure and regulation of massage therapists. Cities and towns are no longer
authorized through their local boards of health or otherwise, to issue massage therapy licenses
and/or regulate the field.

Reiki Healing Treatment
Because Reiki is a very high vibrational energy, it can flow into, over Throat; Communication issues. Have you swallowed your anger
and through anything, including solid matter. This enables it to work and hurt? Are you expressing your feelings? Are you telling the
holistically on the whole person chakras and aura, body and mind- truth?
consciousness, emotions and spirit. As Reiki flows into our aura and
physical body, it helps to break down energetic disruptions or
blockages, clearing and balancing the chakras and straightening the
energy pathways (meridians) to allow the life-force to flow in a
healthy and natural way around the whole body. This influx of high
frequency healing energy stimulates and accelerates the body's own
natural healing ability, so that pain relief and physical healing can
take place quickly and easily — sometimes at quite extraordinary
speed.
Reiki is guided by a Higher Intelligence, it can make its way to those
areas of the physical body and energy body that are most in need of
healing, with out any conscious direction from either the healer or the
recipient. Reiki automatically adjusts to suit the recipient, so that
each person receives as much or as little as they need, at an appropri-
ate rate of flow.
Shoulders; Are you carrying too many burdens? Do you always put
yourself last in your list of priorities? Is your life too stressful?
Hands; Associated with giving (right hand) and receiving (left
hand), and the details of life. What issues or situation can you not
handle?
Back, Associated with stored anger and resentment, feeling
unsupported and trying to be perfect, s well as money issues and
indefinable fears.
Chest (heart/lungs); Relationship issues, self- esteem and feelings
of worthlessness, suppressed emotions, feeling smothered or
controlled by others.
Legs, Associated with progress through life, fear of change, fear of
the future, and family or parental issues. Who/what is holding you
Reiki acts to heal, harmonize and balance the whole self, and as it is back?
guided by a higher wisdom and always works for the highest good of
the person receiving it, it cannot be harmful in any way. The
potential for healing with Reiki is unlimited, so anything can treated,
but it is important to rid yourself of specific expectations of what it
will do, and how fast it will perform.
Many physical symptoms can be eased very quickly, while others
may need several repeated Reiki treatments before starting to
respond. However, it is essential to remember that it is a person's
own body —either your own, if you are self treating, or a client's if
you are treating someone else —that is actually doing the healing.
Your body sends you messages every day: to highlight that
something is not right in your life; to nudge you into noticing that
you are going in the wrong direction; or to bring to your attention the
fact that there are lessons to be learned that you are ignoring. The
trouble is, we are not speaking the same language, especially if we
think every "accident" is accidental, every pain is just something to
be gotten rid of and every illness is just an inconvenience and
something to be suffered until it is over. If you are frequently unwell,
could the underlying reason ("dis-ease") be that you need to address
issues ("stuff') going on in your life.
Causative Issues Linked with Body Parts
This list is only a brief example of a complex issue and is not
intended to be regarded as the "truth" in every case. See if they "feel"
right to you; they are generalizations and each rase is individual, so
you may need to explore the issue in more depth.

journey, as well as creativity, imagination, and spiritual and psychic
issues.
Right side of body, Represents our masculine side and our outer
journey, as well as money or job issues, or other practical, physical
and material concerns.
Eyes; Show how we "see the world. What are you not prepared to
see? Are you looking at things from an unhelpful perspective?
Ears; What is it you are unwilling to hear? Are you avoiding listen-
ing to your inner guidance?
Knees; Linked with stubbornness, inflexibility and indecision. What ..
decision are you afraid to make? Are you being obstinate over
something?
Ankles; Do you need to change direction? Is your life unbalanced?
Feet; Associated with security and survival, reaching our goals or
completing tasks, fear of taking the next step and being "grounded."
What messages is your body sending you? What is some-
thing you would like to work on to assist in your healing
journey?
*Reiki flows through every essential part of our bodies it is very
important to intake as much water as possible. As the energy flows it
will do what it is supposed to do. So when a body is properly
hydrated this keeps our bodies functioning and moving as it was
meant to be. *
