The window system, which is now installed in countless restaurants and bars is a major development in changing the overall look and feel of our establishment. It brings a feel of outside dining without actually being outside. It gives our business the opportunity to reinvent the dining experience as we know it. An "outdoor cafe" feel is an opportunity for us to bring a better atmosphere to the Rt. 28 area. We feel strongly about how this would improve the look of the great Island area in addition to the significant improvements we have already completed. With the emergence of corporate chains in the area we need to take steps to "keep up". Molly's has been a family run operation for the last fifteen years and we are simply trying to compete. We feel that this will give us the opportunity to do so. With the changes that are going on, we feel that these alterations we've made will help Molly's, a "mom & pop" establishment survive. Moxley Molly's Restaurant & Bar sou wa'.0 f REVISED SUPPLEMENT TO MINIMUM SANITATIO`: STANDARDS FOR FOOD SERVICE ESTABLISHMENTS OUTSIDE CAFES The following regulations are promulgated by the Town of Yarmouth Board of Health, in accordance with the provisions of Chapter 111, section 31, as amended, of the Massachusetts General Laws. The applicant shall refer to the State Sanitary Code for basic require- ments. The following are some of the criteria that must be met prior to the Board's consideration of a variance from 105 CMR 595.000 State Sanitary Code Article X: Minimum Sanitation Sta-ndards for Food Service Establishments. a) Applicant must submit application to, and be approved by, the Town Site Plan Review Committee. 1) a site plan will be required according to Section 1432 of the Zoning By-law,,, to assure compliance with all applicable codes. b) Sufficient restrooms, both for customers and employees, must be furnished, courting the additional outside seating as required by the State Plumbing Code. c) The existing sub -surface sewage System must be determined adequate to the Board of Health for the proposed additional seats, according to section 310 CMR 15.00 (-)f the State Environmental. Code Title 5: Minimum Requirements for Sub -surface Disposal of Sanitary Sewage. d) Seating capacity shall be determined by the Board of Health after submission of plans and visual inspection. e) The dining area must be set back ter_ (10) feet from the property line, sidewalk, or public access way (parking lots, etc.). A divider, such as a small fence, shrubs, etc., must mark the designated setback. f) The dining area must be part of the restaurant property whether leased or owned. The dining area must be mentioned on the described premises as in the case of a Common Victualler's License. g) A self-contained drainage system designed to eliminate odors will be required for all outside dining areas. Conveniently located hose bibs must be available for washing down the dining area. hiI) Provision.must be made by the applicant to protect against the entrance of rodents, flies, roaches, and other vermin, into the outside dining area and into the parent- establishment. 2 - i) Trash dumpsters shall be situated no closer than SC feet from an. outdoor dining area. If such a dumpster is in the line of sight from the dining area, it must be hidden from view by a stockade or other such fencing. The area around the dumpster and stockade must be kept clean and free of litter. Dumpsters must be kept closed with adequate covers designed to prevent entrance of rodents and vermin and completely free of odors. j) The patio or other dining area surface must be of such construction or material as to be readily cleanable and not be susceptible to inordinate amounts of dust, mud or debris. (Brick, tile, concrete, or similar type washable surface, would be examples of acceptable material). k) Table tops must be so designed and of such material and workmanship as to be smooth, non -porous, easily cleanable and durable; and shall be in such repair as to be readily maintained in a clean and sanitary condition. 1) A menu shall be submitted to the Board at the time of application for a variance. Any addition or variation of the menu must be sub- mitted to the Health Department for approval.- m) Food service personnel must continuously police the dining area for paper and other trash. Placemat clips, cup holders and other such devices must be utilized to prevent blowing paper. Covered trash receptacles must be provided in close proximity to the dining area, and must be kept from over -flowing. n) Strict clean-up practices must be adhered to. Waitresses, waiters and/or buspersons must be employed to clean up after each patron as in .indoor dining. Each establishment must abide by all regulations contained in Article X, ?Minimum Sanitation Standards for Food Service Establishments of the Commonwealth of Massachusetts, Department of Public Health Sanitary Code. o) Outside food handlers must have easy access to handwash sinks, clean cloths, and to facilities where sanitizing solutions can be easily prepared -and discosed of. p) Hair nets or other effective hair restraints such as hats covering all exposed hair shall be worn by all outside food or drink handlers. Beards and mustaches must be neatly trimmed. THE ABOVE CRITERIA ARE NOT INCLUSIVE AND ARE ONLY FURNISHED AS A GUIDE- LINE. THE BOARD RESERVES THE RIGHT TO DENY VARIANCES FOR ANY OTHER CONDITIONS THAT MAY APPLY TO SPECIFIC LOCATIONS. ANY VARIANCE GRANTED BY THE BOARD MAY BE REVOKED FOR SANITARY VIOLATIONS AFTER AN OPPORTUNITY FOR A HEARING IS PROVIDED Tt-iE PERMIT HOLDER. 590.019: continued z. (3) Outside storage areas or enclosures, if used, shall be kept clean and shall be large enough to store all the garbage and refuse containers necessitated by disposal pick-up frequency. Garbage and refuse containers, dumpsters, and compactor systems located outside, shall be stored on or above a smooth surface of nonabsorbent material, such as concrete or machine -laid asphalt, that is kept clean and maintained in good repair. (C) Disposal Garbage and refuse shall be disposed of often enough to prevent the development of objectionable odors and the attraction of insects and rodents. 590.021: -Insect and Rodent Control (A) General. Effective measures shall be utilized to minimize the entry, presence, and propagation of rodents or of flies, cockroaches, and other insects. The premises shall be maintained in a condition that prevents the harborage or feeding of insects or rodents. (B) enines Openings to the outside shall be effectively protected against the entry of rodents. Outside openings shall be protected against the entry of insects by tight -fitting, self -closing doors, closed windows, screening, controlled air currents, or other means. Screen doors shall be self -closing, and screens for windows, skylights, transoms, intake and exhaust air ducts, and other openings to the outside shall be tight -fitting and free of breaks. Screening material shall not be less than 16 mesh to the inch. (C) Pesticides and Rodenticides. (1) No person shall apply insecticides or rodenticides except: (a) in accordance with M.G.L. c. 132B, 333 CMR 10.00 and any other applicable law; and (b) In accordance with the manufacturer's labeling; and (c) in such a way that food, food contact surfaces and the supply of potable water are not contaminated. (2) No open pesticide or rodenticide bait boxes shall be used. 590.022: Physical Facilities: Construction and Maintenance V)u_di DLO (A) Floor Construction. CIyIh9"s ri Sm�ic�n� (1) Except as specified in 105 CMR 590.022(B), floors and floor coverings ZPae_- preparation, food storage, and warewashing areas, and the floors of refrigerators, dressing rooms, locker rooms, toilet rooms and vestibule: constructed of smooth nonabsorbent durable material such as sealed concrei quarry tile, ceramic tile, durable grades of vinyl asbestos or plastic tile, or tight -fitting wood impregnated with plastic, and shall be easily cleanable and Maintained in good repair, Nothing in 105 CMR 590.022 shall prohibit the use of anti -slip floor covering in areas where necessary for safety reasons. (2) Floors that are water flushed or that receive discharges of water or other fluid wastes or are in areas where pressure spray methods for cleaning are used, shall be provided with properly installed trapped drains. Such floors shall be constructed only of sealed concrete, terrazzo, quarry tile, ceramic tile, or similar materials and shall be graded to drain. (3) In all establishments utilizing concrete, terrazzo, quarry tile, ceramic tile, or similar flooring materials, or where water flush cleaning methods are used, the junctures between walls and floors shall be coved and sealed. In all other cases, the juncture between walls and floors shall be coved so as not to present an open seam of more than 1/32 inch (0.8mm). (B) Floor CaiDetine. Carpeting, if used as a floor covering, shall be of closely woven construction, properly installed, easily cleanable, and maintained clean and in good repair.
