Dear Mr. Cohen:
On March 15 and 16, 2012, I visited your property at 97 South Shore Drive, South Yarmouth, MA
02664, along with Yarmouth Fire Department Captain Inspector Jonathan Sawyer and Yarmouth
Plumbing/Gas Inspector Russ Robbins. I observed considerable repair and renovation work in progress,
including replacement of walls and insulation. I also observed that 5/8" drywall, which covers one side of
trusses in the attic at approximately 20' intervals, has been cut open, perhaps in order to allow ready
access to the entire attic. These openings negate any possible fire protection that such a barrier might
provide. Additionally, there are holes between the attic and rooms or chases below.
On March 16, 2012, I posted a Cease & Desist Order on the property, pursuant to 780 CMR
Massachusetts State Building Code, and the provisions of the International Existing Building Code
Section 113 Violations, and Section 114 Stop Work Order.
Please be aware that you are hereby required to comply with the following provisions of the IEBC:
Section 105 Permits
Section 105.4.0 (MA Amendment) Investigation and Evaluation
Section 106 Construction Documents
Section 106 6 Design professional in responsible charge
In brief, you are hereby required to cease and desist from any further work requiring permits that have not
already been issued, and to engage a MA -certified design professional who will direct the project from
this point on., and who will certify the work that has already been done.
