Through the implementation process of 527CMR 527 31.00 we have tried to
work with the many motel properties in Town to limit their expenditures. This
process has served us and the operators well in all but the property at 97 South
Shore Drive SY. On 4/1/2008 a permit to install Carbon Monoxide Alarms was
issued to a licensed alarm technician, Mr. Kevin Bradshaw.
The narrative and plan provided were not in an acceptable format, but we
decided to try to work with your property and contractor to accomplish the goal. At
no time have we or the electrical inspector been called for a final inspection, and yet
we find the property is open and operating. In the interest of public safety you are
ordered to submit to the Yarmouth Fire Department by 0800 on July 1, 2009 a
stamped ,signed Fire Protection Engineer's evaluation and plan of the installed
system. The engineer must comment on all components of the fire and carbon
monoxide system or systems, their operation and compliance status.
It will be the intent of the Yarmouth Fire Department to order closure of the
97 South Shore Drive property on July 1, 2009 if a report has not been received.
Based on that report we will have an understanding of the installed system or
systems and if they are operating properly and compliant to the applicable CMR's
and will;be the basis for further discuss and resolution.
It is not the intent of the fire department to create a hardship for the
ownership or management of the property. These actions are in the best interest of
public safety and are only contemplated when all other remedies have been
exhausted.
