Dear Mr. Ormon:
This letter is to serve as a follow-up to your letter of May 24, 2000 concerning the occupancy
load of the proposed deck. The following is a review of the occupancy calculations relating to
the. proposed deck and the current listed occupancy of the interior, in relation to the existing
parking:
1. Available parking spaces=82
2. Allowed total occupancy based on available spaces=246
3. Proposed deck occupacny=34
4. Net allowed interior occupancy based on available parking=212
5. Net reduction required of interior seating is 15. This is based on the latest Certificate of
Inspection of 227. If the actual existing number of interior seats is less that 227 the
elimination of seats may be reduced proportionally.
In summary, the total of interior and deck occupancy shall not exceed 246, with a maximum of
34 on the dec&

Dear Mr. Ormon:
This is to serve -as a follow-up to our meeting of May 3, 2000 and the issuance of building permit
number B-00-825 of May 4, by Inspector Rhynd , which allowed for the construction of a
24'x24' deck and access. The restaurant lies within the Town's B-1 zoning district. The use is
currently permitted under Section 202.5 The building permit was issued subject to the following
compliance issues:
1. The maximum occupancy for the deck shall be limited to 41, pursuant to Table 301.5- Parking
Demand. The current number of actual parking spaces is 82 as per the certified site plan
presented. The occupancy as per this department's annual Certificates of Inspection is 227.
Accordingly, a minimum of 76 parking spaces are required. You proposed a deck occupancy
total of 41; 16 seats and 25 standees. To comply with parking demand requirements for 82
spaces, you agreed to reduce the number of seats in the interior bar/lounge from 74 to 51 and
offset that number on the deck. This department will confirm this change during our final
inspection. Deck Total=41 Interior Bar/Lounge=51 Re: 780CMR (State Building Code)
Chap. 1, Section 111.20-Zoning
2. All structural changes will have to be approved by the designing engineer, D. Braman
3. The serving or consuming of alcoholic beverages on the dick is subject to the approval of the
licensing authority.
4. The serving of food on the deck is subject to the approval of the licensing authority.
5. The deck access shall comply with 521 CNIR (Access Regulations).
6. The deck shall be constructed as per OKHRD approval.
The aforementioned are conditions of building permit B-00-825. This department will inspect the
premise for zoning and OKHRD periodically.

finally, pursuant to 780CMR, Section 106.5, I am enclosing an application for this year's
Certificate of Inspection, with expires June 20, 2000. Please complete it and return it with your
fee payment of $50. All certificates issued henceforth will reflect the aforementioned occupancy
limits.

Pursuant to the provisions of the Massachusetts State Budding, 780 CMR, Section 106.5.1, you are
required to apply for a Certificate of Inspection for the building located at 6 Bray Farm Rd. Y.P.
DBA Oliver's Restaurant.
Please complete the enclosed application and return same with payment of the noted fee to the Town
of Yarmouth Building Department, 1146 Route 28, South Yarmouth, MA 02664. Checks should
be made payable to the Town of Yarmouth.
Unless otherwise requested, inspections wiU be unannounced. Typically the following
elements / systems are inspected: fire protection equipment, means of egress elements including
emergency lights, exit signs, egress doors & hardware, clear path of travel, adequate lighting and
occupancy total. Also, the building shall be maintained and adequate housekeeping provided to
insure public safety. Violations will be provided in the form of a Violation Notice and will delay the
issuance of your certificate.
Finally applications and fees must be received within ten (10) dayj of receipt of this letter.
Failure to comply may Jeopardize your license where applicable and /or the occupancy of the building.
