Heaslip The property noted above is listed in the department rental files in accordance with Chapter 108 By Law. I was contacted by Mr. Paul McBride at the.Red Jacket in mid -July upon completion of construction and issuance of the certificate of occupancy. I completed an inspection of the dwelling on July 15, 1999. The dwelling was found to be ready for occupancy at that time. There are no known violations at the property or with the operation or use of the property. Upon researching the .issue of 18 Kearsage Road, with respect to an alleged extension of the Red Jacket Motel, I have determined the following: 1. The property located at 18 KearsageRd. is currently owned by Red Jacket Beach Ltd. Partnership 2. This location contains a single family structure as defined by the Town's Zoning Bylaw, Section 500 "One:familyDwelling—A building containing mane (1) dwelling unit with not more than three (3) lodgers or boarders." This means that providing a structurc's _physical layout is consistent with a single family and is not rented to more that three separate lodgers or boarders at one time, it meets the criteria for a single family dwelling. 3. An occupancy permit was issued by this department for single family use. 4. Based on the -Board of Health records, .hundreds of single family dwellings are rented year round and have a high level of turn -over during the summer months Based on the foregoing, J- ind that the propertyin question, although it may be rented with a high turn -over rate, and is held in common ownership with the Red Jacket Motel, it meets the definition of the Zoning Bylaw fora one family dwelling and .is therefore not a business use. However, the owner should contact the Board of Health concerning the rental permit. Lawton, JrG.%'G�% Town Administrator SUBJECT: 18 Kearsage Road DATE: September 2, 1999 TOWN ADMINISTRATOR �obe�l4l�on, Jr. Z 1999 On Thursday, September 2, 1999 I was visited by Ms. Anne Evans of 15 Kearsage Road concerning the property at 18 Kearsage Road. Ms. Evans states that a new house has been built on the property by Davenport Development. It is her understanding that the house is now being used as an extension of the Red Jacket Motel. She states that the hotel staff cleans the property and provides other services. There is a direct path to the motel and when she has questioned people staying at 18 Kearsage they state they are staying at the Red Jacket Motor Lodge and consider themselves guests. Therefore, the question is, is such use of 18 Kearsage Road a violation of zoning as this would potentially be a commercial activity in a residential zone.
