This letter will confirm our discussion on this date relative to summer cook -outs at the
Red Jacket Inn. In light of the pending litigation concerning Red Jacket's ability to use
the area in question for commercial purposes, it is my opinion that no food service
permits for cook -outs should issue for 1998. Further, it is my belief that prior permits
were issued in error and in all probability should not have issued.

Request for Outdoor Food Service - Cook -Outs

This department has received a written request from Red Jacket Motor Inn to allow cook -outs as
follows:
1. Family style cook -outs, July and August.
2. There will be approximately 19 dates for outside food service between July and
August on Tuesdays and Thursdays.
3. Red Jacket Motor Inn staff and kitchen personnel will organize and oversee each
event and will confirm to all regulations according to the state sanitary codes.
4. Meals for these events will be served to Red Jacket guests only.
The cook -outs are performed by the kitchen staff and are conducted on the adjacent property owned
by the motel, which is currently zoned as residential.
As the current zoning case on the use of this lot is still pending a legal ruling, I would request to meet
with the town's special counsel, Atty. Bruce Gilmore, for an opinion, to determine if the Board of
Health can issue a temporary food service permit to the Red Jacket Motor Inn to a property on which
the motel is not located, and is not zoned for commercial use.
