HomeMy WebLinkAbout2011 Mar 11 - Memo to Acting Town Admin.; EmailTOWN OF YARMOUTH 1146 ROUTE 28, SOUTH YARMOUTH, MASSACHUSETTS 02664- 4451 Telephone (508) 398-2231 Ext. 1277, Fax (508) 398-2365 MEMORANDUM TO: Peter Johnson -Staub, Acting Town Administrator FROM: Jennifer Coutinho, Program Coordinator Y- DATE: March 11, 2011 RE: 6 New Hampshire Ave (former Red Rose Inn) DEPARTMENT OF COMMUNTFY DEVELOPMENT I am providing you with an update on recent activities with 6 New Hampshire Avenue, the site of the fonner Red Rose Inn. It is my understanding that Marty Reilly has contacted staff to discuss the Town's possible acquisition of the parcel. On March 4 h, the property owner, 6 New Hampshire Ave, LLC, furnished me with a letter to document that Mr. Reilly is authorized to represent them "in any matters concerning the Town of Yarmouth". I spoke with Mr. Reilly on March 8 h, and informed him that the Community Preservation Committee (CPC) would discuss the parcel at their meeting on March 9"'. The CPC would be interested, for example, if the Recreation Department and/or Natural Resources Division had an interest in the parcel for possible future uses. Mr. Reilly also furnished me with a municipal lien certificate. Enclosed please find a letter from Mr. Reilly dated March 7 h. It is my understanding that the owner is currently reviewing their options, which would be to rebuild or sell. On March 9t', the CPC met with Patricia Armstrong and Karl vonHone. They discussed several potential uses of the parcel. At this meeting, the CPC did not vote to recommend the community preservation application submitted by Mr. Reilly on February 23, 2010. They did, however, unanimously vote to obtain an update to the appraisal that the Town had completed on the property in April 2010. The appraisal update will likely take four weeks to complete. At the same time, staff must verify the feasibility of the potential uses, complete due diligence, and determine if the proposed uses are eligible under the Community Preservation Act. Once this is accomplished, the Town could begin negotiations with the owner. In addition, Town Counsel would have to complete a title search and draft a purchase and sales agreement. Mr. Reilly and I discussed the timeline and I explained to him that this acquisition could not be considered at Annual Town Meeting 2011 because the warrant is closed and the abovementioned tasks must be completed, which is not likely to occur within three weeks. I explained that, if the Town is interested, it could be considered at a future Town Meeting. Please note, article 36 of the May 2010 Town Meeting was to purchase this parcel. However, the CPC indefinitely postponed the article from the floor because the owners did not accept the Town's offer. I will keep you informed of any new developments with the property. This fact coupled with - recent developments regarding the owners of the property's plans to acquire another oceanfront property in West Yarmouth in which to consider relocating and operating the Inn/ Restaurant - may once again make the property available for the town to purchase for the benefit , enjoyment, and use of town residents and visitors for posterity. Please share this memo with the Members of the Community Preservation Committee - for their review - as they discuss the possible interest of the CPC in acquiring the Red Rose Inn Property at 6 New Hampshire Avenue at your Meeting on Wednesday March 9, 2011 at Town Hall. As we discussed, the owners of the Red Rose Restaurant/ Inn are very interested in continuing to operate in West Yarmouth and are now reviewing their options relative to rebuilding the Red Rose at the 6 New Hampshire Avenue property site - but they may prefer to operate out of the other waterfront location in town which they have identified - where they could consider moving the Reataurant/ Inn. This could possibly make it feasible for the town to acquire the 6 New Hampshire Ave property for uses considered and desired in the past by the Community Preservation Committee, other officials in the Town and neighboring area/ Town of Yarmouth residents - which could be a win win for all parties. Before the owners of the Red Rose property proceed to move forward with any plans for rebuilding on the 6 New Hampshire Avenue property - or another site in town - we would like the CPC to meet and discuss the issue of possible interest by the town in purchasing this property. If the CPC and the Town are interested in purchasing the property - it would be the owners of the property at 6 New Hampshire Avenue's intention to first offer the property to the town for purchase - before moving forward with any other redevelopment, use or sale of the property. Based on this important CPC decision - the owners will render their final decisions as to how they will proceed going forward at 6 New Hampshire Avenue. Please call me following the March 9, 2011 CPC Meeting to inform me of the committee's sentiments.
