However, there are outstanding structural issues which were found during the Department of Public Health inspection of the swimming pool and whirlpool that requires a 4 foot unobstructed walkway around both. You must keep the Health Department informed of the progress of an engineer assessment for the corrections. To that end, you will be scheduled for another Board of Health meeting in January, 2015 to advise the Board of the corrections. The swimming pool and whirlpool must remain closed starting January 1, 2015 until all issues are resolved. When ordering new chemicals used in the operation of the pool the Department recommends updating all MSDS sheets. 2. The Consumer Product Safety Commission (CPSC) has issued a notice of recall for certain drain covers originally listed as compliant with the Virginia Graeme Baker Pool & Spa Safety Act. The Department recommends you contact the manufacturer of your drain covers to ensure they have not been recalled and remain compliant with the Act. 3. The Department did not re -test the bromine level in the spa as the facility indicated both the pool and the spa had been closed and will remain closed indefinitely. 4. At the time of inspection, the Department recommended: a. Demarcating the riser corners of the inlet in the second step of the pool with a 4 inch stripe of a contrasting color on each edge; b. Demarcating the low -hanging pipes at theentranceof the filter room; c. Demarcating the low -hanging faucet heads on the ceiling in the filter room; d. Demarcating the step into the filter room; e. Demarcating the filtration system supply and return pipes in the filter room with green and red arrows respectively, to better determine the direction of water flow; and f. Safely covering the exposed wires just outside the filter room. 5. At the time of inspection, the Department recommended an area for notes be included in the chemical log book. This facility does not comply with the Department's Regulations cited above. I was contacted through the Yarmouth Police Department regarding a drowning at the Riverview Resort. When I arrived at the site, I was met by several police officers and your front desk manager. A review of water quality testing log revealed that there were 13 days that the pool was not tested or limited testing was conducted rather than the required 4 times per day. This is a violation of the state swimming pool regulation. It was determined that the front desk manager had his pool safety training as required by the Yarmouth Board of Health. On October 22, 2014, a state Department of Public Health representative inspected the swimming pool and spa. The DPH inspection revealed several items that needed to be corrected along with a review of the structure to address not having 4 foot walkway around the pool and spa. All the items from the DPH inspection have been corrected except the structural issues, stair projecting into the pool and painting of the pool. As you are in violation of the DPH swimming pool regulation, in particular not conducting the required water quality testing of 4 times a day, you are hereby required to attend the Board of Health meeting on November 17, 2014 at 5:30 PM in the downstairs hearing room at the Yarmouth Town Hall for a show cause hearing regarding your pool/spa license. At that time, the Board will determine if any action should be taken regarding your pool/spa license including suspension, revocation or conditions placed on the license. William Butler, 68, who had multiple medical issues, was seen at the bottom of the pool shortly before noon, Cape and Islands District Attorney Michael O'Keefe said. Police and fire officials were called to the resort, located on Parker's River, at about 11:45 a.m., said Yarmouth fire Capt. David Morley. Police officers arriving at the resort, dove into the pool and pulled the man from the water, according to witnesses and a statement from Yarmouth police. Police then performed CPR, but Butler was "not viable for resuscitation," according to O'Keefe. He was then taken to Cape Cod Hospital, Morley said. The incident remains under investigation but does not appear to be suspicious, O'Keefe said. Shortly after he was pulled from the pool, officers were trying to determine whether Butler was staying with anyone at the resort, which has 44 units, according to its website. A woman outside the pool said her daughters worked at the resort and found Butler in the pool. A 9-year-old girl from New York drowned and her 12-year-old sister almost drowned in the indoor pool at Bayside Resort in West Yarmouth in August. The Yarmouth Board of Health unanimously voted last month to take no action against the owner of Bayside Resort for not having a staff member certified in CPR, first aid and water safety "on the premises" as is required by the town's regulations. Xiarhos Deputy Chief Yarmouth Police Department Excellence in Policing THE YARMOUTH POLICE DEPARTMENT MEDIA RELEASE Monday, October 20, 2014 Yarmouth and State Police Investigate Drowning in Resort Pool On Sunday October 19, 2014 at approximately 11:47AM the Yarmouth Police and Fire Departments were dispatched to the Riverview Resort at 37 Neptune Lane in South Yarmouth for a reported drowning as a subject was observed lying on the bottom of the pool. Yarmouth Police Patrol Officer Sean Geary and Detective Scott Lundegren were the first to arrive and found bystanders around the pool staring at the victim who was still underwater lying on the pool bottom. Officers Geary and Lundegren quickly jumped into the pool and removed the victim from the bottom. At this point, Patrol Sergeant Gerard Britt and Patrol Officer Michael Zontini arrived and assisted Officers Geary and Lundegren in getting the victim out of the pool and on to the patio where lifesaving measures began. Members of the Yarmouth Fire Department arrived and continued advanced lifesaving measures and transported the victim to Cape Cod Hospital in Hyannis where he was unable to be revived and was pronounced deceased. The victim was subsequently identified as a 68 year old male named William Butler of Springfield Gardens, New York. Yarmouth Police Detective Russell Giammarco and the Massachusetts State Police are conducting an ongoing investigation. Town of Yarmouth Health and Building Department officials were called out to the scene to assist in the investigation. Riverview Resort has always ensured that a properly trained employee be onsite 7 days a week to correctly test and balance the pool 4 times each day. However within the last 6 weeks Riverview Resort was forced to release from employment one of our maintenance men, resulting in a temporary lapse of pool testing 2 days a week. To remedy this Riverview Resort has hired a CPO -certified maintenance employee that is starting November 1st.. A copy of this employee's CPO Certification will be faxed to the Yarmouth Health Department. As a secondary measure, our current CPO, Aqua Pool Co., will be training resort managers as well as selected Front Desk employees on proper pool testing and balancing. As always, Aqua Pool Co. is also always available to report to the resort to assist if needed. It was also requested that we provide written confirmation on how we maintain our employee CPR, First Aid, and Water Safety certification. Prior to opening each season the resort ensures that we have trained and certified employees. All managers, department supervisors, and front desk employees are fully trained and certified, and schedules are designed to ensure there is always one trained employee on duty during pool operating hours. Copies of employee certifications are provided to the Yarmouth Health Department when submitting our annual pool application. Reminder triggers are in place to notify us when employee certification is reaching expiration, with proper time to retrain our employees prior to the expiration date. All current employee certification should be on file with the Yarmouth Health Department. All other deficiencies from the Yarmouth Health Department's Pool Inspection Report have been addressed. Regarding the State's structural concerns of the pool; a structural engineer has been contacted and investigations into these concerns are underway. It should be noted that we are still waiting for the official report from the Massachusetts Department of Public Health. I arrived at the resort at approximately 1:20 PM and was met by several police officers. It was explained that William Butler, a 68 year old male, was removed from the deep end of the pool by 2 police officers and transported to Cape Cod Hospital by the Yarmouth Fire Department. A visual inspection of the area noted the following: (Photos Taken) 1. Pool clarity within the pool was fine. 2. Bottom drain at deep end was visible. 3. No Lifeguard sign was posted. 4. No Swimming Alone sign posted 5. Depth markings were visible 6. Safety dividing line buoy and buoys separating shallow and deep end were in place. 7. Entrance doors self -closing and self -latching worked only intermittently. 8. Water test log book showed several missing dates of testing. 9. Front desk manager had the required safety training. 10. Chlorine above standards. 11. Shepherd's crook and ring buoy present. 12. Pool phone rings at front desk. If no answer after 3 to 5 rings, it transfers to 911. Yarmouth police officers, Fire Department paramedics as well as EMTs from a passing Dennis ambulance responded to Bayside Resort on Route 28 at about 7:30 p.m. Wednesday after the two girls — ages 9 and 12 were pulled from the resort's indoor pool, according to police. Both girls, who were visiting with their family from New York and being supervised by an uncle at the time, were taken to Children's Hospital in Boston. Yarmouth police were notified Saturday morning that the 9-year-old was being taken off life support and she later died, Yarmouth Deputy Police Chief Steven Xiarhos said Monday. "We notified our officers first to let them know," Xiarhos said, adding that the department was notifying the public because of an outpouring of concern for the girls. The 12-year-old girl is still being cared for at Children's Hospital, according to police. Bayside Resort General Manager Rod Sroczenksi did not respond to a message left Monday seeking comment. There was no lifeguard at the pool and guests performed untrained CPR on the girls once they were pulled out of the water, police said. Lifeguards are not required at public or semipublic pools in most towns on Cape Cod. Yarmouth health officials had performed a routine and unannounced inspection at the pool earlier in the day Wednesday, but at the time the girls were pulled out of the water, there was no staff member on duty who was properly trained in CPR, first aid and basic water safety as required by town regulations, according to Yarmouth Health Director Bruce Murphy. During the earlier inspection, an inspection that night after the incident, as well as one the next day that included state Department of Public Health officials, the pool's water was clear and other required safety measures such as a throw ring and shepherd's crook were in place, Murphy said Monday. "Public and semipublic pools, such as those associated with hotels, are permitted at the local level and the local board of health enforces compliance," Department of Public Health spokeswoman Anne Roach wrote in an email. The department will often provide technical assistance to local officials when requested and has not completed its report on the inspection at Bayside, Roach wrote. The lack of a trained staff member on duty will be addressed during a show -cause hearing at the Yarmouth Board of Health's Sept. 8 meeting, Murphy said. In the meantime, the hotel's owner has scheduled courses to get eight to 10 additional staff members certified in CPR, first aid and basic water safety, Murphy said. The hotel currently has four people certified, he said. After hotel management showed proof that the resort had at least two people on staff with the appropriate certification they were allowed to reopen the pool Friday afternoon, Murphy said. Pools in Yarmouth are intermittently shut down for brief periods during the summer primarily because they are out of balance chemically, Murphy said. Firefighters had to break down a door leading out of the pool area because it was padlocked, he said. "If it's an exit it has to be open," Grylls said. The door has since been repaired and is now able to be opened from the inside, he said, adding that the notice to the hotel is only a warning at this point. The pool is between 4 and 8 feet deep and very well lit, according to Xiarhos. The investigation into the girl's death is now being handled by the state's Office of the Chief Medical Examiner and detectives assigned to Cape and Islands District Attorney Michael O'Keefe's office with assistance from Yarmouth police, according to Xiarhos.
