Based upon the information you provided to me, I contacted the Building Commissioner
regarding Board of Appeals or other permits you might need. I have enclosed a copy of
his response to me which indicates that you do not have to go to the Board of Appeals.
The permits you will need will be for the amusement devices which can be applied for
through Cushing Amusements as well as any tents. If food is to be served, the
Amusement Company will need to contact the Yarmouth Board of Health to secure food
service permits. From our conversation and from your conversation with Dan Horgan, I
believe that you are going to use the MacArthur John Simpkins. School field. The Board
of Selectmen can issue a permit for those three days (August 12, 13, and 14) after the
various inspectors have approved the carnival. You also should contact the Yarmouth
Police Department as it may be the case that people will be using the town hall and other
parking lots across Route 28 and you may need to have a special detail to assist people in
crossing Route 28.
Therefore, I believe the next step is for you to have Cushing Amusements contact the
Building Commissioner and the Board of Health to start the permitting process.
