Whynott et al Our File No. 19, 494 Gentlemen: This is to certify that I have examined the record title to the • within-described parcels of land and report as follows: LOCUS: Locus is shown as Lots 18 and 20 on Land Court Plan 30949-D and Lot 25 on Land Court Plan 32462-F, copies of both plans being enclosed. TITLE: Title is presently in Vernon D. Whynott and James F. Ruhan, as tenants in common, by Certi- ficate of Title No. 61098. ENCUMBRANCES: There is an outstanding mortgage of record running in favor of Constance P. Ruhan in the original principal amount of $50,000. 00 covering locus and other land dated February 14 , 1974 and registered as Document No. 183,502. A discharge will he necessary. There is an easement running in favor of the Town of Yarmouth for the installation of water mains over Lot 20 dated September 21, 1976 and registered as Document No. 212,310. There is similarly an agreement made by Messrs. Ruhan and Whynott running in favor of the Town of Yarmouth registered as Document No. 212, 311. This agreement provides that no building permits will be applied for on Lot 19 on Land Court Plan 30949-D until such time as municipal water has been installed to service that lot. Lot 19 on Land Court Plan 30949.-D has been subdivided and Lot 25 on Land Court Plan 32462-F is a portion of Lot 19. Lot 20 contains an old way known as Ables Road. Ables Road is subject to the rights of all persons '� lawfully entitled thereto in and over the same. ; �� RIGHTS: Locus has an appurtenant right of way over Ables j Road to Higgins Crowell Road in common with others entitled thereto.
