HomeMy WebLinkAbout2019 Apr - Letters Re: Failed Septic System a F� p TOWN OF YARMOUTH :,t` .' 1146 ROUTE 28,SOUTH YARMOUTH,MASSACHUSETTS 02664-24451 �' Telephone(508)398-2231 ext. 1240, Fax(508)760-3472 BOARD OF HEALTH April 9, 2019 Mr. Michael Williams Building Dreams, Inc. 692 Walnut Plain Road Rochester, MA 02770 RE: Failed Septic System— 10 & 12 Ventura Way, South Yarmouth,MA Dear Michael: The Yarmouth Health Department hereby confirms that the existing septic system servicing 10 & 12 Ventura Way, South Yarmouth, MA is in failure per Title 5, 310 CMR 15.303 (1) (a) for one or more of the following reasons: - There is backup of sewage into the facility served by the system or any component of the system as a result of an overloaded and/or clogged soil absorption system or cesspool; - There is discharge of effluent directly or indirectly to the surface of the ground through ponding, surface breakout, or damp soils above the disposal area; - The septic or cesspool requirespumping more than four times a year. Repair and/or replacement of the failed system components is hereby required per Title 5, 310 CMR 15. 305 (1) (a) and shall commence within sixty (60) days of receipt of this notice. April 5,2019 --7Z0-al- 7000 I Michael Williams SLC/ S Building Dreams,Inc. 692 Walnut Plain Road Rochester,MA 02770 -- 1 Reference: CDBG Program Year 2019 Affordable Rental Housing Rehabilitation Program 10& 12 Ventura Way, South Yarmouth,MA Dear Mr.Williams, I am writing to inform you that your application for funding to repair the failed septic system of the duplex located at 10 & 12 Ventura Way, South Yarmouth, MA has been approved for$10,000. This award is conditioned upon the following: 1. The Town of Yarmouth Health Department or a qualified Title V inspector has failed the system at said location. Please submit supporting documentation of the system _ failure. 2. Both tenant households renting at the duplex earn less than 80% of the Barnstable County Area Median Income. Please have both tenant households complete the attached Application for Financial Assistance, and submit to this office with all required documentation. 3. The rent charged to the tenants of said duplex are affordable to households earning 80% of the Barnstable County Area Median Income. Please submit the executed leases between Building Dreams and the tenants for review by the Town. 4. The property is deed restricted affordable. 5. The installation costs of the new system is priced out by at least three licensed contractors,and that the lowest bid is used. 6. The engineered plan and installation of the new septic system are inspected and approved by the Town of Yarmouth Health Department. Payment shall be released upon the issuance of a Certificate of Compliance by the Health Department. I have enclosed two copies of the contract for your review and signature. Once signed by you, please return one copy to my office, and retain the other copy for your records.
