Dear MR. SABEN
The Town of Yarmouth Board of Health has received your application requesting a
variance from the provisions of the State Environmental Code: Title 5, and/or
from the Town Amendments to Title 5, under the Regulation/Section as stated above.
Having determined that strict enforcement of the above Regulation/Section in this
instance would do manifest injustice and, further, that your requested variance
does not conflict with the spirit of the State Environmental Code or the Town of
Yarmouth Amendments to Title 5, the variance is hereby granted as.follows: .
TO ALLOW THE FOUNDATION ELEVATION TO BE AT 0. 6 ' BELOW THE. HIGH
POINT OF THE ROAD AFFRONTING THE LOT INSTEAD OF THE REQUIRED 2.0' ABOVE
THE HIGH POINT OF, THE ROAD AFFRONTING THE LOT:
THEREBY GRANTING A VARIANCE..OF 2.6FEET. •
You must provide a 3/4 inch negative grade surrounding the foundation for a mini-
mum
of fifteen (15) feet.
You are hereby advised that the variance granted herein will expire in 90 DAYS
from the date of'issue. All work authorized by said variance must be completed
prior to the date of expiration AUGUST 31 , ,1983
In granting this variance the Town of Yarmouthassumes no responsibility for any
water damage to the foundation, septic system, onto adjoining lots.
I understand and accept the conditions of the requested variance as herein set-
forth, and agree to comply with the conditions thereof. -
