I did speak with Mr. Dunbar a couple of times to confirm the Commission’s expectations. The Commission continued
the hearing twice to allow him to address the outstanding issue but after no further action was taken and there was no
further update, they voted to deny rather than have it sit on the agenda indefinitely. He can reapply once he is
compliant with the Order.

Hi Kelly,
I received the COC denial letter today. This April 8 comment must have slipped past you, or if not, the Commission just
doesn't believe Mr. Dunbar's intention. Lots of banditos in town. I could not insist to him that I represent him at the
hearing.
I might have suggested that enforcement on future non-compliant conditions would always be a remedy or table the
application until summer.
I'll let him know he can try again during the summer season.

Good Morning Kelly,
I was away for part of last week and missed responding to your note.
I contacted Jim Dunbar and related your concern to him. He expressed that he was unclear what to do in advance of the
seasonal install activity, that he understood he was not to install the entire float system, and that he would have the extra
float carted out when the crew comes to install the other. I think the iron pipe anchors would be removed also when a
crew is there to set up the seasonal situation. I think he may drop in to assure you of his intentions.

Any update on when they are removing the float and poles? I just drove by and they are still there. The COC request
was continued to tonight so I will need to update the Commission.

Mr. Dunbar told me a few minutes ago he was going to have the float installer take the second float away when they arrive
to install. I suggested to him that the float anchor slides for that float be removed also.
With less than 3 ft. of water I'm doubtful he can acquire a local approval for the second float. What do you think?

The Commission continued the hearing for 3 Swordfish Certificate of Compliance request to April 4. The Order
contained a condition that the non-complaint float be removed from the water and not return. The additional float is
sitting on the driveway and the poles for it are still in the water so they are concerned that the property owner is
planning on returning the float. Are you able to contact the property owner and confirm their intentions for the float?
