Notice is hereby given of the applicability of the Town of Yarmouth Board of Health for a deed
restriction, 92 Astor Way.shown in Town Assessors Book dated 2018,Map 9_9_, Parcel 85. As
Deed is recorded in the Land Court at the Barnstable County Registry of Deeds on the Deed
Certificate# 143159 and Document#684236.
As plan of land is recorded in the Land Court at the Barnstable County Registry of Deeds, on a
subdivision plan titled Land Court Plan 31209-D Sheet 1. Lot 70 and dated October. 1970.
The engineered plan prepared by All Cape Septic LLC ,dated November 30.2018 approved
by the Health Department on December 17.2018 ,requires a maximum,not to exceed:
(1) the number of bedrooms not to exceed, Two (2)per design restrictions:
Title 5, 310 CMR 15.214, Nitrogen Loading Limitations, Zone II Areas of
Wellhead Contribution

common, with quitclaim covenants
the land situated in Yarmouth (South), Barnstable County, Massachusetts, bounded and
described as follows:
SOUTHWESTERLY by Astor Way, One Hundred (100) feet.;
NORTHWESTERLY by Lot 71, One Hundred (100) feet.;
NORTHEASTERLY by a portion of Lots 74 and 75, Otte Hundred Four and 43/100
(104.43) feet.; and
SOUTHEASTERLY by Lot 69, One Hundred (100) feet.
All of said boundaries are. det.erniined by the Court to be located as shown on subdivision
plan 31209-D (Sheet. 1) dated October 1970, drawn by Barnstable Survey Consultants,
Inc., Surveyors, and filed in the land Registration Office at. Boston, a copy of which is filed
in Barnstable County Registry of Deeds in Land Registration Book 250, Page 32 with
Certificate of Title No. 32102 and said land is shown thereon as LOT 70.
Said land is subject. to: the rights granted in an easementgiven to the inhabitants of the
Town of Yarmouth, dated December 14, 1970, being Document No. 147,039; the rights
granted in an easementgiven to the Cape & Vineyard Electric Company et al, dated May
21, 1971, being Document No. 148,155; a notice of variance in favor of Davenport. Realty
Trust, being Document. No. 161,211; and all other rights, easements and restrictions of
record insofar as now in force and applicable.
The, premises are conveyed subject to ail occupancy agreement recorded herewith.
