Dear Mr. &Ms. Librandi:
This is to serve as a follow up to the October 23, 2018 Notice of Violation issued by Building Commissioner Mark
Grylls, concerning the creation and use of the detached garage, as a dwelling unit, at 111 North Main Street, South
Yarmouth,Ma. Said Notice cited the following:
Failure to obtain a Building Permit—Re: 780CMR, Massachusetts State Building Code, Section R-105.1
,Required Building Permit and Failure to request required related inspections—Re: R-110.5.
In addition,you are hereby notified that you are also in violation of 780CMR,Section R-111.1 Use and Occupancy,
as amended, which provides: "No building or structure shall be used or occupied and no change in the existing
occupancy classification of a building or structure of parts thereof shall be made until the Building Commissioner,
Inspector of Buildings,----has issued a Certificate of Occupancy therefore as provided herein."
Our records show that Commissioner Grylls subsequently reached out to you by phone.The records also reflect that a
November 7, 2018 email was sent to you by Ms. Sandi Clark with a complete Board of Appeals application package
attached. That email included the filing date deadlines for the months of December,January and February,2019. The
required Board of Appeals relief cited in the October 23,2008 Notice of Violation, relates to the Town of Yarmouth
Zoning Bylaw, Section 407. Unfortunately,you failed to file this application.
Accordingly, you are hereby advised to take appropriate action by June 22, 2019. Failure to do so will result in the
issuance of tickets which carry fines of up to$1,000 per day per violation,with each day constituting a separate violation,
as prescribed by MGL,Chap. 148A and 780CMR, State Building Code.
Finally,I suggest that you or your representative meet with either me or Building Commissioner Grylls by June 22 to
review the specific Zoning Bylaw Sections to insure the relief you are to seek, is all inclusive.

Thank you for taking the time to speak with me today on the violation notice. Per our discussion
I can either take up he appeals process for the unit, turn away the renter, or remove the
"dwelling" status of the building.
I am going to start the appeals process at this time. I will schedule a meeting soon with you or
James and will make arrangements to review my appeal with you before putting this on
the agenda for the next board meeting.
I appreciate the time you've given to me today and back in November around this issue.
