As an update, Glenn Harrington got back to us today via email. Glenn did assist Janis with the plan but did
not do the initial inspection, he confirmed that was done by Sean Gold. According to Glenn, Sean has
confirmed that the tank passed. We have submitted a request to Sean on his website on the status of the
inspection report.

I just spoke with Jay and advised him I would be emailing the information to you also to place in your file. I hope to get
the permit issued and in the mail by today.
During the installation, I will be inspecting the following items and ask that the construction crew do the same and
advise our office of anything different:
1. Inspection of the septic tank to confirm satisfactory inlet and outlet tees and that the tank does not appear to be
leaking
2. Inspection to determine if the tank needs to be pumped. Jay advised me this is usually included as part of his
proposal.

Conservation Drive,Yarmouth:
1. Per Title 5 regulations, a septic system is required to be inspected by a MA Title 5 Certified System Inspector at
or within 2 years prior to the property transfer to new ownership. Typically,the inspection is completed prior to
the transfer of the property and is usually handled by the seller, however, it is not a requirement that it be
completed by the seller if another party chooses to take responsibility. Our office does not have a valid
inspection report on file to date.
2. In lieu of a Title 5 Inspection, a Certificate of Compliance issued after the installation of a Title 5 septic system
can be used in place of the Title 5 Inspection as long as the Certificate of Compliance is no older than 2 years at
the date of the property sale. The Certificate of Compliance is only valid for the newly installed septic
components. In your situation,the engineer has designed a new distribution box and leach facility, and is
proposing to re-use the existing 1000 gal septic tank installed prior to 1995. In order to validate and ensure the

4. To ensure that the septic system at 3 Conservation Drive is fully Title 5 compliant as it relates to the System
Inspection requirement,the following will need to be addressed:
a. The existing 1000 gal septic tank will need to be inspected by a MA Title 5 Certified System Inspector. The
inspector will need to certify that the tank meets the minimum requirements outlined in the Title 5
Inspection Report. The report will need to be submitted to the Yarmouth Health Department within 30 days
of the tank's inspection and within 6 months of the property transfer date, OR
b. The existing septic tank can be replaced with a new 1500 gal septic tank. The new septic tank will be added
to the Certificate of Compliance to be issued with the rest of the new septic components to be installed.
It would seem reasonable to have the engineer inspect the existing septic tank since he is a Certified System Inspector
and have his report submitted to the Health Department to meet the requirements listed above. The inspection can be
completed by any Certified System Inspector and does not have to be the engineer. It is not uncommon for the pre-
1995 1000 gal septic tanks to be re-used in routine septic system upgrades in Yarmouth. When septic system fails, it is
typically the distribution box or leach facility rather than the septic tank. An inspection will ultimately determine the
present condition of the tank.
I would recommend reviewing your purchase and sales agreement with your real estate agent and/or your attorney to
determine what requirements were established between the seller and the buyer. At a minimum,the Health
Department will require either a passing inspection report from a Certified System Inspector on the existing septic tank
or require a new 1500 gal septic tank be installed with the proposed septic upgrade to meet the requirements of Title
5.

Good morning.
I apologize for not responding to your voicemail yesterday,but the Town Hall was closed for Patriot's Day.
Glen Harrington, R.S., has turned in engineered septic plans for the repair of the system at 3 Conservation
Drive, and they have been approved by our Assistant Director Amy von Hone. I have attached a copy of the
plans to this email. As you are aware, the septic tank shown on the plan will be the existing tank, and the d-
box and leaching are to be upgraded.
I looked to see if we received an inspection report for transfer of property. Usually an inspection report
indicates whether or not the septic tank"Passes," even when the distribution box and SAS portion of the
system does not. Unfortunately our office has not received an inspection report for this property to date. Do
you know if there was an inspection report performed? If there was, the Health Department should get a copy
of it. Please note that the Septic Inspector has up to 30 days from the date of inspection to turn it into our
office.
As for any specific questions about the proposed septic system, they should be addressed to Amy. I have cc'd
this email to her.

Perhaps if the installer is also a State licensed inspector, perhaps he could also certify the tank at the time of installation
of the other components. For some repairs an inspector will issue a "Passed" inspection after the work is
completed. The passing would include the tank...Just a possibility of what could be done.

My understanding is that the Seller assumed failure of the system for Title V compliance and the state
inspection has not occurred.
Given this scenario, how do we determine whether the tank is suitable for reuse?

The Town will be inspecting the installation of the new components(d-box and leaching).The Certificate of Compliance
will cover only the replacement of the d-box and the leaching as well.

tank at 3 Conservation Drive? This is what the Seller told us, on the premise that the septic tank officially does
not need to be replaced in order to pass Title V.
