First, the car parts that were uncovered were very old and I saw no evidence of hazardous materials present. Second, the small amount of discarded construction material consisted of only wood and perhaps nails. While I am not an asbestos inspector I did not see any material that looked like it might contain asbestos. Furthermore, this material was discarded illegally, without the consent of Mr. Maki, the property owner. Mr. Maki does not plan to discard or accept construction material for disposal at this site in the future. He does plan to install a gate at the beginning of the access road to guard against future unauthorized access. Third, Mr. Maki's only plan for the site are the acquisition and storage of clean loam and sand for his exaction business. These materials need to be clean because (1) the sand is to be used for placement surrounding Title 5 leaching structures and (2) the loam is to be used in conjunction with grass seed in the restoration of ground disturbed by such projects. Fourth, I will advise Mr. Maki of his obligation to report releases of hazardous materials above applicable thresholds to Mass DEP, yet at this time I understand his operation is under review by the Yarmouth Building Dept. for compliance with Town Zoning Bylaw. Therefore, at this time I am unsure of whether or not the operation will continue or if zoning relief will be pursued (and if pursued, granted). Sincerely, Carl Carl E. It also appears to me to be Yarmouth Assessor's Map 107, Lot 67 on West Great Western Rd. There are few landmarks in the area and no utility poles on this section of road. I happened to meet Mr. Chris Maki onsite. Mr. Maki is the owner of Cape Cod Septic Services in West Yarmouth (508-775-2825) and he stated to me that he bought the property from the Town at auction. His planned use of the lot is for obtaining and storing clean sand and screened loam for use in his business. At the time of my visit Mr. Maki explained that he was using his excavator to clear the lot to the boundary lines. We walked the property together and I observed the site conditions which I outline below. Regarding materials on the lot: 1) In the course of clearing the lot Mr. Maki uncovered an old automotive chassis, some scrap metal (some of which appeared to be crushed auto fuel tanks) and vehicle tires. 2) Brush and wooden construction debris were recently and illegally disposed on the lot by unknown parties. 3) Mr. Maki has stockpiled some stumps and trees in the course of clearing his lot. The discovery of old auto parts is not surprising as some longtime Yarmouth residents have stated this area of Town has received illegal dumping over the course of past decades. I did not observe the presence of any hazardous materials or trash. Mr. Maki's outlined his plans for the property to me and they are as follows: 1) The old automotive chassis and misc. scrap metal will be recycled. 2) The brush and stumps will be hauled offsite and disposed of at S & J Exco in South Dennis. 3) The cleared trees will be processed into firewood and removed from the site. 4) The automotive tires will be taken to the Town of Yarmouth Disposal Area. 5) Once clean the lot will then be used for sand and loam storage as mentioned above. 6) A entrance gate will be installed to prevent future illegal dumping.
