Yes, me again. My same neighbor sent me a video late this afternoon. She said Mrs. Baker of 22
Tern Rd. was dumping her garbage in the back yard, moving it around with a rake, then digging a
hole and covering up the hole!
It's all on the video she sent me.
This has to stop!
I can come to your office and show you all of my videos's or I can burn them to a DVD disc and send
them to you in the mail?
Something has to be done about this!

Your voice mail said that you inspected the Baker's residence with a police officer about 3 weeks ago
because of our formal complaint which we asked for in May of this year.
Here is my response to your voice mail:
Here is a copy of the bill which I hope you can understand is very upsetting to us! Critter control of
Yarmouth came out in May and reviewed the situation and could not understand why we had a rat
infestation! They said our property was clean and had no issues? I told them about the neighbor's
and explained what the mother was doing every evening!
He set up about 7 traps that day and came back 2 weeks later and re set the traps again! They were
all exterminated on 5/29/2018.
I don't understand why it took your office so long to investigate?
I work in the health industry and I was not going to just let 2 very large rat infestations take over,
destroy and infect the health of my family and my property! The first infestation was under our shed
and the second was more alarming and under our deck which is attached to our home. There were
about 15 rats total!
We contacted your office in May and are not happy with the response time of your office?
The rats came onto our property because of the actions of Mrs. Baker.
We had the rat holes all over our property! Not hers! Which is why you saw no evidence when you
visited and inspected her property!
I have pictures of the rat holes, videos of the rats... as well as a video of her throwing her dirty dish
food water off her deck which abuts our property. She also comes out every evening and cleans off
the food from her plate onto the ground off her deck!
I do not take pleasure in taking videos of my neighbor's! We have had nothing but problems with the
family since we moved in 2 years ago! That is another issue that we deal with the police about!
Her son does his clothes every weekend and opens his back basement door and puts the washing
machine hose out into his back yard? We are just assuming that they have septic issues? Honestly
not for us to say? Just reporting on what we have seen since we moved into our home 2 years ago!
Our neighbor has also left complaints about this family with your office and has called the
environmental police on them in the past. Not sure of those results? Just letting you know that we
are not the only family on our street that are dealing with these problems!
We have taken care of the recent issue with Critter Control. But —if this happens again we will
discuss our options with an attorney and go from there and be in touch with the town.

Cape Wildlife Services, Inc is a locally owned and operated franchise of Critter Control, Inc.
SERVICE AGREEMENT
INSPECTION FEE: An inspectioniservice call fee shall be paid to cover the costs of inspection, consultation, a written report, and trap set up (if needed). This fee
can be prepaid by credit card prior to the date of the initial inspection appointment and is due whether services are performed or not.
ANIMAL CHARGES: Animals trapped or removed will be charged on a per animal basis. Any animal caught from underneath a building or coming from a
target hole is considered a target animal. Any animal released without authorization from Critter Control and all skunks are considered target
animals. Non -target cats caught will be released on site with customer's permission, returned to owner (if known) or removed and handled
according to state or local regulations. Cats will be charged at the target animal amount per cat to cover delivery of cat to local animal shelter and to cover
any associated animal shelter' ees incurred by Critter Control.
PAYMENTS: All monies are due in full as services are rendered. All accounts are due upon receipt. Unpaid balances are subject to a 2.0% per month interest
(24% annual rate) and any collection or attorney fees incurred pursuing collection of this debt. Critter Control accepts Visa, MasterCard, American Express and
Discover.
OWNERS RESONSIBILITY: The property owner/customer shall make reasonable efforts to keep everyone, including children and pets; away from traps, bait and
pesticides. The property owner/customer agrees to make their property accessible during normal business hours for service. The property owner/customer
agrees not to touch or move the traps nor release any animals from the traps. The property owner/customer agrees to be responsible for traps on
their premises (replacement cost $99.00 each). The property, owner/customer agrees to promptly return phone calls, signed service agreements and/or repair
authorizations to Critter Control to avoid any disruptions in service. Some nuisance wildlife are capable carrying various parasite growth of some microorganisms.
Critter Control services do not include an assessment for the presence of these organisms in your air vents, attic or crawl spaces or any other space in your
residence. Furthermore. Critter Control also offers no assessment of the health status of the animals captured, nor the presence or absence of such organisms
possibly associated with the animal. Information on these organisms can be obtained from your state and local health departments.
ARBITRATION: The property owner/client and Critter Control agree that any controversy or claim between them arising out of or relating to the interpretation,
performance, or breach of any provision of this agreement shall be settled exclusively by arbitration. Such arbitration shall be conducted in accordance with the
Commercial Arbitration Rules then in force of the American Arbitration Association. The arbitration award shall be final and binding on both parties. Judgments
upon such arbitration award may be entered in any court having jurisdiction. The parties further agree that arbitration shall take place in the state in which the
services were rendered. unless both parties agree otherwise.
WAIVERS: The property owner understands debris may be tracked into the building outdoors and/or attics. The technician will make reasonable efforts to keep
this from happening: but Critter Control will not be responsible for incidental tracking. Rodent control treatments may occasionally result in odors. There will be
additional charges for dead animal removal and deodorizing in these isolated instances: should they be requested.
GUARANTEES:
• Inspection Fee is good for 15 days from the date of this contract. An additional service fee is required to continue service after 15 days.
Permanent repairs are guaranteed for two (2) years at point of repair , unless otherwise arraigned.
• Temporary repairs are not guaranteed. A permanent repair must be done by or arranged for by the property owner/customer.
• Chimney Caps are guaranteed against removal for lifetime. Chimney screen are not guaranteed.
There will be no warranty work performed on accounts that are unpaid and/or overdue.
CREDIT CARD APPROVAL: An authorized credit card is required to guarantee payment of inspection fee, all animals caught, and any exclusion
(repair) work performed by Critter Control. The property owner/customer authorizes Critter Control to apply charges to their credit card on
file. Any deposit received is NON-REFUNDABLE after three (3) business days.

Dear Mr. Baker,
Thank you for your time when we visited your property last week in response to an
anonymous complaint of rats on your property and a washing machine discharge hose
from your basement into the backyard.
Findings
It was noticed during a site visit that bird seed and shell hulls were on the ground behind
your home. The seed and hulls are known to attract rats.
Rat burrow holes were observed.
Also, while not in place at the time we discussed the washing machine discharge hose
that at times is placed from the machine to the backyard.
Violation
1) Unsecured food or animal feed items are a violation of Massachusetts State
Sanitary Code 105 CMR 410.600.
2) While no rats were observed during our visit we observed several burrow holes.
Please be aware that the presence of rats is a violation of Massachusetts State
Sanitary Code 105 CMR 410.550.
3) The discharge of water from washing machines to the surface of the ground is a
violation of Massachusetts Title 5 Septic Regulation 310 CMR 15.024 (8).
Corrective Measures
1) Please remove all bird seed and seed hulls on the ground in your backyard.
Please do not put any more seed on the ground.
2) Please bait and trap to eradicate any remaining rats in your backyard.

3) Please refrain from placing the washing machine hose so that it drains on top of
the ground in your backyard.
Please correct the aforementioned condition and contact the Health Office during the
week of Aug. 27 for a follow-up inspection. We also may visit the property if we are in
the area.
We appreciate your ongoing efforts to maintain your property.
Please contact me with any questions and thank you in advance for your attention to
this matter.

Dear Mr. Baker,
This department has received several complaints regarding rats on your property. After
our visit with you at your property on Aug. 13 our dept. mailed you a violation letter on
Aug. 23. This letter detailed our findings, listed your violations, requested that you take
corrective measures and then contact the Health Office for a follow-up inspection. To
date we have received no word from you.
On Wed., Dec. 5 we visited your home in an attempt to meet you for a follow-up
inspection, but there was no answer at the door.
Findings
As noted previously during the site visit of Aug. 13 bird seed and seed hulls were
present on the ground behind your home with rat burrow holes present. The seed and
hulls are known to attract rats.
Violation
Based on the observed conditions you are in violation of the following Massachusetts
State Regulations:
105 CMR 410.550: Extermination of Rodents
105CMR 410.602 Unclean and Unsanitary Conditions
105 CMR 410.750 (1): Conditions Deemed to Endanger or Impair Health or Safety
Corrective Measures
You are hereby ordered to:
1) Cease and desist immediately from allowing the presence of bird seed and seed
hulls on the ground of your property.

2) Hire a Massachusetts -Licensed exterminator upon receipt of this letter to
eradicate rats from your property.
3) Provide a copy of the exterminator's report to the Health Dept. within 7 days.
You have a right to appeal this order according to 105 CMR 410.850 by submitting a
letter to the Board of Health within 7 days of the receipt of this letter.
Failure to comply with this order will result in fines as provided by 105 CMR 910 — 920
and/or court action
