Thanks for your email. I intended to try to make the 7/18 meeting, but we've had relatives visiting from out of
country and couldn't make the meeting work. I copied/pasted a "rough draft" of a letter that I started a few
weeks ago, below. (Pictures to follow).

Dear Mr. Bishop,
I write to the Conservation Commission to provide an update from the June 06. 2019 meeting, and also to
explain the reasoning for the course of action that took place regarding the porch upgrade project.
UPDATES:
The stair frame to the back
of the porch has been completely removed and the area has been returned to the original
condition. No further work will take place until all approvals are granted.

On June 19, 2019, I met
with Bob Goddard, the local manager from Patio Enclosures. We discussed the concerns about their
recommendation that a building permit was not required for the porch upgrade. He agreed with the
Patio Enclosure salesman that sold us the job and Bob stated
“that due to the fact that the house footprint was not changed, the original roof and porch were present,
and the project was in the rear of the home that is not visible to the public, a building permit was not
required for this type of job”. Bob Goddard's

The porch sketch plan has
been updated to move the stairs to the west side of the porch, next to the house.
PAST COURSE OF ACTION REASONING:
This was my first time dealing
with the town of Yarmouth and the Old Kings Highway permitting process. Trying to understand and
follow the process was somewhat confusing.
A permit was granted for
the porch project from the Old Kings Highway on 05/03/2018.
On the check-list provided by the OKH, the Conservation Commission section was not checked off for
requiring
approval, only the Health Departments and OKC sections were checked off. If Conservation
Commission section was checked off, I certainly would have contacted the Conservation Comm. prior
to contacting the Building Dept. I met with the Building Inspector shortly
after obtaining the OKH approval.
Soon thereafter, a quote was received from Patio Enclosures for the porch project. By going this route,
it
would save considerable time, labor and overall cost.
The statement/direction from Patio Enclosure, a National firm with a solid reputation, that does a lot of
business
on the Cape, “that a building permit was not required”, was another factor in pursuing this route.

Per the OKH printed information, there are “exterior feature exemptions eligible for certificate of
exemption
application” - 1. Exterior construction that will not be visible from any way or public place.
The construction of the temporary stair test frame at rear of porch was to try to determine the stair
layout
per code. Stairs are one of the most challenging parts of home building.
During the meeting with the Conservation Commission on June 06. 2019, three requests were
requested: 1. Remove
temporary stair frame; 2. Develop stair plan for the west side of the porch; 3. Contact Patio Enclosures
to discuss their lack of permit recommendation.
The above three requests are complete.
CURRENT COURSE OF ACTION:
Seek the advice and recommendations from the Conservation Commission and hopefully the Building
Inspector to proceed with the project.
