Dear Kerry -
This is further to our Notice of Intent/ Order of Conditions as modified by letter of BSC dated October 23, 2013.
On July 17, 2015, a Certificate of Occupancy was issued by the Town of Yarmouth pursuant to Permit No FB - 14- 1309
construction having been completed.
On June 1, 3 and July 9, 2015 mitigation plantings in consultation with your department were completed by Joyce
Landscaping. These plantings included 30 Ornamental Grasses along the perimeter of the retaining walls, 35 Bearberry
plants along the southerly retaining wall and in the adjoining garden on the Fyfe property, and 20 Low Bush Blueberry
plants adjacent to the Delaney property abutting the Fyfe property on the north westerly side. In addition, three
hydrangea plants were planted against the foundation of #7 next to the entry and the garden gate. The total plantings
came to 88 plants. Most of the plants have survived the summer and the fall, a few have failed and will be replaced in the
spring. The landscape Plan was prepared in consultation with the Conservation Administrator in compliance with
Paragraph 14 of the Order.
The Storm Water Catch Basin was covered with filter paper throughout construction and was kept free of debris of any
kind. The leeching pits are likewise clean and free of debris. As of this writing, there is no debris in the catch basin and the
system is clean. The first quarterly visual inspection has been performed as required by Paragraph 15 of the Order as of
November 17, 2015.
The Order of Conditions expires by its terms on June 5, 2016. June 21 is the official beginning of summer. By the Terms
of the Order Paragraph 14, a Certificate of Compliance cannot be applied for until the Spring growing season is complete.
Accordingly, I am formally requesting a one year extension of the Order of Conditions so that the spring growing season

may be completed before the Certificate of Compliance is applied for. If there is additional paperwork required to obtain
this extension, please let us know.
