Assuming we come up with a solid plan to manage the nourishment and address the rack and path and restoration of the bulkhead end, and salt marsh planting, and avoid any silting in of the river? Yes, my understanding is that if the vote was taken and if their were not enough votes, then the motion does not pass, and another motion would need to be be made. I want to thank Rick for trying to reach the compromise; I know it got a little complicated, but he pushed through; I really appreciate that. So, yes, let's continue, but it will have to be the August 15 meeting; I am out of town on August 1. I thought we reached a good compromise of the project goals, with the ability to manage them as well. Can we continue the hearing (I don't think it was voted to close?), to re-address the issues, and come up with a plan that works for all of us? I mentioned monitoring the MHW line, and if it's more than 15 feet out, then they can't nourish. We can lower the nourishment amount as well. I don't understand why Ellie thinks the river is being filled in when the contours show over 6 feet of water in front of the site. The sand isn't going to "skip" over the deep area and collect in the sand bars; it's just not practical to think that; the sand (in the area of the bars) must be coming from somewhere else. I think they have to be able to do something, because of past practices, etc., but mostly because if they don't, they will loose the beach and the wall. What does your town council say on the matter? Section 1.05(2) Actions by the Commission states: Actions by Conservation Commission. Where the By-law states that a particular action, (except receipt of a Request for Determination of Applicability or Notice of Intent), is to be taken by the Commission, that action is to be taken by more than half of the members present at a meeting of at least a quorum. Where the By-law states that a permit or notification shall be issued by the Conservation Commission, that action is to be taken by a majority of the members then in office, who need not convene as a body in order to sign said permit or notification, provided they met pursuant to the Open Meeting Law, M.G.L. chapter 30A, sections 18-25 when voting on the matter. Where the By-law states that the Conservation Commission is to receive a Request for Determination of Applicability or a Notice of Intent, Conservation Commission means a member of the Conservation Commission or an individual designated by the Conservation Commission to receive such Request for Determination of Applicability or Notice of Intent. 5 So regardless of the determination by the state – which I will still look into- the bylaw regulations don’t allow me to issue an Order approving the project based on the vote taken.
