Applications must be submitted two weeks prior to the next scheduled Conservation Commission meeting. No new information may be accepted into the Commissioner’s packet a week before the meeting. Failure to follow the Administrative Checklist guidelines shall result in an Administrative Incomplete Application and will not be advertised for a Public Hearing. Contact the office if you need assistance. Submitting an Application: ______ 1 original application with original signatures (double sided). ______ 7 copies of the first and second page of the Notice of Intent (double sided). ______ 8 copies of a comprehensive and detailed narrative of the project including existing & proposed conditions, construction sequence, type of equipment, staging locations, drainage and stormwater, erosion controls, invasive species management and alternative analysis. The narrative shall document how the project meets performance standards per 310 CMR 10.0 & TOY Wetland Bylaw, Chapter 143, BVW delineation sheets or other supporting information. ______ 8 copies of the plan, folded separately, right side out with title visible and attached to each application. Project Description Notice of Intent 206 Blue Rock Road South Yarmouth, Massachusetts PROJECT DESCRIPTION 1.0 INTRODUCTION The proposed project is located at 206 Blue Rock Road in South Yarmouth (the Site) involves the replacement and expansion of a previously removed section of deck, as well as the raze and replacement of an existing garage within existing maintained lawn/paved areas. For more information, please refer to the attached Site Plans. This application is being submitted in accordance with the Massachusetts Wetlands Protection Act and the Town of Yarmouth Wetlands Protection By-law. 2.0 SITE DESCRIPTION The property located at 206 Blue Rock Road in South Yarmouth contains a single-family home, lawn, vertical wood bulkhead and pier, ramp and float. It is abutted by single-family homes to the north and south, Bass River to the east and Blue Rock Road to the west. The Wetland Resource areas and areas of conservation jurisdiction that are protected under the Wetlands Protection Act and the Town of Yarmouth’s Wetland Protection Bylaw include:  Land Under Ocean  Salt Marsh  Coastal Bank  200’ Riverfront Area (RFA) – Bass River  Land Subject to Coastal Storm Flowage (FEMA Flood Zone AE 11) 3.0 PROPOSED ACTIVITIES The purpose of this application is to permit the following: Deck – The proposed project at the site consists of the replacement and expansion of a deck in currently maintained lawn, which was the former site of an approved deck. The previous two- story deck was removed due to damage sustained from the installation of new septic components by the prior owner (see attached photo page with photos from 2015). The new owners would like to replace a portion of the former deck, second story only, along the width of the house. The proposed deck will be within the 200-foot RFA to the Bass River and the 100-foot Buffer Zone to the top of Coastal Bank. The approximately 308± square feet (sf) footprint of the proposed deck will be reduced in size compared to the previous deck and will be within the 35-foot No Disturb Buffer Zone to Coastal Bank. The proposed deck will be located outside the 50-foot Buffer Zone to the Mean High Water (MHW) line associated with the Bass River. All work associated with the proposed deck will occur within the footprint of the previous deck. Given that the proposed deck will be constructed over the existing retaining walls, lawn, and septic components and that the proposed deck will not be constructed closer to the resource areas than the previous deck, the project is unlikely to negatively impact the resource areas and their respective buffer zones. Garage – The proposed project includes the raze, adjustment, and replacement of the existing garage within the 200-foot RFA to the Bass River and the 100-foot Buffer Zone to Coastal Bank. The proposed garage will be angled to better line-up with the existing house and will be expanded over an area which currently consists of pavement and lawn. Two trees will be removed for the installation of the garage; however, these trees include a landscaped Japanese Maple (Acer Notice of Intent 206 Blue Rock Road South Yarmouth, Massachusetts palmatum) and an invasive Norway Maple (Acer platanoides). The proposed garage expansion consists of a roughly 485 sf structure over existing disturbed areas. 4.0 ALTERNATIVE ANALYSIS Altered Garage and Deck Replacement Scenario – In this scenario the proposed replacement of the deck and garage would be altered to mimic the previous size and configuration of the aforementioned structures. Alternatively, the positioning of the garage and or deck could be moved to another side of the single-family home. These alternatives would not provide a significant benefit to either the natural resource areas or the applicant, especially considering that no positioning of the garage and deck would for these structures to be outside of all resource areas. The replacement of the garage in its existing orientation with the single-family home would not suit the applicants’ needs. Further, the replacement of the deck as it was previously built would result in the larger structure footprint than the proposed replacement deck. No Build Scenario – In this scenario, the proposed work would not take place. This scenario would not be ideal and would not help meet the needs of the new owners. The homeowners would not have an improved protected space for their cars and other storage or have their deck restored after the previous deck was removed as a result of unforeseen damage. Additionally, the disturbance from existing retaining structures, driveway, and lawn would remain in the areas where the replacement deck and garage are proposed. This option would result in an increase to the impact within Coastal Bank and the 0-100’ RFA, as it would eliminate the proposed 316 sf of mitigation planting. Proposed Scenario – In this scenario, the work would proceed as proposed. This would present the greatest benefit to the applicant, in that it would provide the optimal space for the storage and protection of their vehicles and allow for the replacement of the previously existing deck. The use of appropriate erosion controls and the locations chosen for the garage and deck replacements within existing disturbed areas will result in little to no adverse impacts on the resource areas. The proposed deck and garage will reduce disturbance within the 0-100’ RFA and Coastal Bank by 316 sf. In addition, the removal of the invasive Norway Maple, as well as the planting of a mitigation area within existing lawn will serve as benefit to the health of the surrounding ecosystem. 5.0 MITIGATION Access to the site will be gained from Blue Rock Road, paved surfaces, and existing lawn. Any disturbed areas will be loamed and seeded or landscaped following the completion of the project. All appropriate erosion controls will be installed before the commencement of work on the Site and will be maintained until the Site has been stabilized. A mitigation planting plan has been drafted, which includes the removal of 316 sf of lawn and the planting of native plant species within the Coastal Bank and 0-100’ RFA along the Bass River. The proposed planting palette is attached below and is also included on the Site Plan.
