I agree the NOI filing can better address matters as more will be known but we’ll be in the unenviable position of apparent non-compliance with the EO and that I must avoid. The required action is based on my understanding the Commission’s requirements for addressing the violation. The EO is on the agenda to allow the Commission to review, edit and ratify it. I will pass on your concerns to them and your request to continue the matter to the Sept 5 meeting, on the basis that there will be more information on which to base their review. If they choose to ratify the EO please note that the NOI will still provide the opportunity to better define the resource areas and proposed/past activity. I left you a voicemail to discuss the contents of the draft and the fact it will be discussed tonight. In short, the findings and order are not as I was lead to believe yesterday and severely prejudice us as there has been no determination of a dune, removal nor regrading. As I explained , we are having core samples done. Moreover, we do intend to file a new NOI regarding beach cleaning and nourishment and as part of that will include mitigation measures, but the extent of those cannot be known until the sampling is done and an opportunity is provided to discuss the same with the Commission, which I understood would take place at a status review on 9/5. Lastly, there was no mention and it infeasible to have any type of restoration plan done on or before 9/5, putting aside the fact that the scope of the same is unknown. My attending tonight on such short notice will prove problematic if this is still going to be discussed, and thus, I’m asking for the courtesy of being present when such discussions take place, an accordingly, that this not be taken up tonight.
