Telephone 508-398-2231 ext. 1261 Fax 508-398-0836 rd VIOLATION NOTICE AJ Tammy Thomas1-11 �� t John Harbour 61 Grouse Ln /c\NtN West Yarmouth, MA 02673 January 3, 2017 RE: 61 Grouse Ln—finished basement 4 Dear Ms. Thomas, The Building Department performed an inspection at 61 Grouse lane on December 7,2016,and it was discovered that the basement has been finished without the benefit of a building permit.Upon further investigation it has also been discovered that no electrical permit was issued for the work completed. This is a violation of the Massachusetts State Building Code section 105.1. You are also required to obtain proper electrical permits. Failure to comply with the MA State Building code 780CMR is subject to fines and penalties as prescribed in MGL CH 143 section 91. Each day constitutes a new violation. Section 91. Whoever violates any of the provisions of sections one to ninety, inclusive, shall, unless another penalty is prescribed, be punished by a fine of not less than one hundred nor more than one thousand dollars. It is also a violation of the Town of Yarmouth Zoning Bylaws section 103.1.1 Failure to comply with the Town of Yarmouth Zoning Bylaw is subject to fines and penalties as allowed per section 101.3 101.3 Penalties.Any person violating any of the provisions of this bylaw shall be fined not more than three hundred dollars ($300.00)for each offense. Each day that such violation continues shall constitute a separate offense. You are hereby directed to apply for the required permits within 14 days of receiving this notice. We do not have any records of a permitted basement apartment at that address. This is a violation of the Massachusetts State Building Code section 105.1 R105.1 Required.It shall be unlawful to construct, reconstruct, alter, repair, remove or demolish a building or structure; or to change the use or occupancy of a building or structure; or to install or alter any equipment for which provision is made or the installation of which is regulated by this code without first filing a written application with the building official and obtaining the required permit.
