Hi Lynne,
Sometime next year so a bit too early to start counting. Looks like it would be a good idea to elevate the
structure. If you stay within the approved footprint, we would treat the change as a minor project
modification and the 99-year license would remain valid.

I have a question regarding an Amnesty License, No. 7227. To submit with the License
Application, the then-Conservation Administrator Brad Hall provided a letter that said the
structure was pre-existing and didn't require a filing. More recently and significantly after the
issuance of the letter from Brad Hall, the Yarmouth Conservation Commission started requiring
older, pre-existing piers to be upgraded to conform to current regulations as much as possible
when the structures are in need of repair. This pier was totally reconstructed this year. The
majority of the structure consists of pipe-secured, seasonal floats, which were all re-built off-
site. The only on-site construction was the fixed section to access the floats. Kelly Grant, the
current Administrator is looking to improve the structure to elevate the fixed section higher and
extend it to eliminate the floats that cut through and ground out on the marsh. The property
owner went through the proper process to secure a 99-year license, including getting the Town's
confirmation that the structure was pre-existing and accordingly permitted at the time the 99-year
license was sought. I am concerned that the improvements the Town may want could jeopardize
the validity of the Amnesty License. If the proposed modifications to the pier are made within
the existing footprint, will the Amnesty License still be valid for the 99-year term?
