As of today the core sampling has not been done and we will not have results before tomorrow night’s meeting. In
addition, our representatives cannot attend tomorrow night, myself included.
As I explained in our call, our goal is to have NOI’s for continued beach management submitted by the end of this month
for not only this property (Green Harbor Resort), but also for Red Jacket Resort (1 South Shore Drive), Blue Water Resort
(291 South Shore Drive), and Riviera Beach Resort (327 South Shore Drive). Included would be proposed “mitigation”
measures at Blue Water/Riviera and Green Harbor. Procedurally, I would ask the Commission to please approve
tomorrow night the COC’s requested for 1552 and 1555 and reconsider and approve the COC for 1553. As indicated,
new NOI’s are forthcoming so it begs the question as to the downside of closing out OOC’s originally issued in 2001.
Regarding the draft EO, as I also explained, there are portions that I believe should be eliminated and rephrased.
Beginning with Section A2, at this point it has not been determined that the area in question is a coastal dune nor has
there been removal of dune vegetation nor regrading. I’ll grant you Google Earth snapshots support a change of
appearance, but until we at least have core sampling I respectfully do not know how a finding concerning a “coastal
dune” can be made. With respect to Section C. Order, box one is not objectionable but boxes two and three are for once
again issues are outstanding as to that area. For box four, the submittal of an NOI as noted above by September 30 is
our goal.
It remains our objective to work collaboratively with you and the Commission for the long term beneficial use of the
properties, and given the absence of any exigency, we’d appreciate the time for investigation and submittals coupled
with the suggested changes to the EO given the state of what is known and not known. Would you be amenable to
forwarding a revised draft EO for review?
