Thanks for contacting me. I have attached the approved plans for the dock and floats. There appears to have been
expansion of the floats in about 2006. I will add the extension to October 31 to the file.

I am the trustee for the Bass River Drummer Realty Trust, the MA nominee real estate trust that owns the property
located at 188 South Street. I received your violation notice Wednesday and went to your offices at Town Hall yesterday
morning to understand what this notice pertained to. I also went to Town Hall again yesterday afternoon and this
morning hoping to discuss this matter with you but no one was in the Conservation Commission office. As I explained to
your co-worker Dawn, I was not aware of any expansion of the dock since we purchased the property in the mid 2000’s.
Dawn was able to print a copy of the approved pier/dock plan on file with the Town of Yarmouth and informed me the
violation pertains to the addition of two 15’ floats. She also mentioned that the notes said the expansion took place in
2004 or 2006 (I can’t recall which date). Unfortunately the beneficiary of the Trust that resided at 188 South St. passed
away in February 2015. However, I do find it hard to believe that he would have purposely violated any regulations.

Having said that I will need more time than the Violation Notice 10 day deadline of September 30 to research and
adequately respond to the Commission on this matter. Therefore I am requesting an extension of your deadline for an

additional month until October 31. This reasonable extension request will not only give me time to understand the By-

Laws and seek help from others more knowledgeable in these matters but will also enable our dock service provider
(Lee Coulton) sufficient time to remove all the floats at the property for the winter months ( the normal course of action
at this time of year) not just the two floats in question. Please let me know if this time extension is acceptable to the
Commission. If you would like to meet to discuss further I would be happy to do that as well.
