HomeMy WebLinkAboutCorrespondence - request for discussion item Grant, Kelly From:Grant, Kelly Sent:Thursday, September 26, 2019 9:21 AM To:'Billy Rogers' Cc:paulshea@meganet.net; aliki_29@Yahoo.com Subject:RE: 6 Fair Wind Circle, South Yarmouth - Project Hi Billy I spoke with the Chairman and he agreed with me that the Commission’s directive during the January discussion was clear – that a Notice should be filed for the extension of the dock to reach greater depth of water (and the other discussed items). Mr. Kantzelis has stated on a couple of occasions that extending the dock will not achieve greater depth of water, however, based on the plan submitted by you this is not the case. Therefore, the request for a discussion with the Commission on this topic is denied. The Commission welcomes a Notice of Intent to finally resolve this matter. Thank you for your attention to this situation. Paul & myself cannot proceed forward with said Project until Mr. Kantzelis directs us regarding this matter. Respectfully submitted, William N. He commented that extending the dock would achieve no greater depth of water than the current dock. I responded that I didn’t think that was the case as the plan was to extend the dock to achieve greater water depth. He responded that it had been confirmed that the water depth was no greater at the extended length. My response was that if this was the case the commission may be reluctant to approve an extension to the dock. I hope this clarifies the situation for you. Ms. Grant: Pursuant to receipt of your email dated March 29, 2019 in which you sent me the Minutes from our January 17, 2019 Conservation Commission Meeting regarding the above captioned Project, Paul J. Shea, P.W.S. & myself are of the Opinion that we were directed by the Commission to Extend the Exiting Dock twenty (20’) feet outward to comply with the Approved Submitted Design Plan. However Mr. Kantzelis, the previous Owner, was and is of the Opinion that this Dock Extension should not be required because the twenty (20’) foot extension will not secure any further bottom elevation. Now I made the Commission aware of this at the January 17, 2019 Meeting. This situation already exists with the present 2 structure on the south which I pointed out at that time. This being said Mr. Kantzelis has called me this morning after Meeting with you this morning and indicated that you were of the same Opinion and agreed that it was your feeling that the Conservation Commission would remove this Existing Dock Extension Requirement! We await your direction? Respectfully submitted, William N. Rogers II, PE, PLS 3
