Re: 114 Cranberry Lane Violations
Dear Mr. Hatch:
In response to complaints received by this department, the following is a summary of citations and letters issued by this
department, concerning the construction of a shed and placement of an on ground swimming pool, which to date, you have
ignored:
-August 13,2015—letter from Inspector Arnault
-September 16,2015--Violation Notice issued by Inspector Arnault.
-October 1,2015—Ticket No.07677, issued by Inspector Arnault.
-January 19,2016—Ticket No.08436, issued by Inspector Arnault.
-August 20,2019—my letter reviewing my August 8,2019 site visit.
-September 13,2019(mail date)—Violation Notice issued by me,citing the August 8,2019 violation. This notice provided
you fifteen(15)days to comply. However,as of today, you have failed to do so.
Accordingly, you are hereby being issued the attached Building Code Ticket No.B051-028670 and Zoning related Ticket.
No. 07266
In addition, during my August 8,2019 site visit I had asked you to remove the ladder at the side of the pool. In addition,in
observing the platform adjacent to the pool more recently, I consider that to be climbable and also a life/safety issue,
pursuant to the provisions of 780CMR,International Swimming Pool and Spa Code,Section 305.5(3)and Section 305.2.5,
entitled"Closely spaced horizontal members". This provision requires that no horizontal member be spaced more than 1 '
inch,to prevent a child from climbing up,over and into the pool. The platform you have constructed contains horizontal
2x4's which exceed this limit. Therefore, you are hereby ordered to remove this platform and/or the pool immediately.
Also,I find no wiring permits for the outlet serving to power the pump/filter system, adjacent to the pool.
Finally, this department has also received complaints regarding an alleged basement apartment. Based on these allegations,
and the potential life/safety aspects of same, you must address this allegation with this department immediately.
So ordered,
James D. Brandolini,
Deputy Building Commission
