Dear Ms. Grant and Members of the Conservation Commission:
Please accept this Request for a Certificate of Compliance on behalf of John Randall (the
Applicant) for the project authorized in the Order of Conditions (DEP File #SE83-2155)
for the property located at 40 Thacher Shore Road, Yarmouth Port, Massachusetts (the
Site). The proposed project at the Site involved the repair of an existing septic system, the
replacement of an existing wooden retaining wall with modular blocks, and a portion of a
wooden wall was proposed to be replaced with stone. A site inspection was conducted by
a BSC Wetland Scientist on September 18, 2019 to assess the condition of jurisdictional
Resource Areas on Site and to confirm that the proposed work was completed as within
substantial compliance with the approved plans. BSC was informed by the owner that in
a conversation with the Agent of Yarmouth it was decided that a line of shrubs would be
planted at the edge of the delineated limit of Bordering Vegetated Wetland in lieu of a
single-rail fence. All other areas of work were determined to be completed within
substantial compliance of the Order of Conditions (OOC) issued on May 7, 2018 under
DEP File#83-2155. As such, we are requesting a Certificate of Compliance for this
project.

All applications must be submitted two weeks prior to the next scheduled Conservation
Commission meeting. Refer to Meeting Schedule
Failure to follow the Administrative Checklist guidelines shall result in an Administrative
Incomplete Application and will not be advertised for a Public Hearing.

B. Submittal Requirements
Requests for Certificates of Compliance should be directed to the issuing authority that issued the final
Order of Conditions (OOC). If the project received an OOC from the Conservation Commission, submit
this request to that Commission. If the project was issued a Superseding Order of Conditions or was the
subject of an Adjudicatory Hearing Final Decision, submit this request to the appropriate DEP Regional
