Project Summary
Installation of two new generators and proposed parking modifications.
Comments
/6 Building: Project is in the B-1 /APD zoning district. Petition #3510 of 10/22/98 allowed expansion of an existing
commercial building. The petitioner at the time proposed to construct only 61 of the 72 parking spaces on the site plan
dated 9/10/1996. The increase of parking in the front of the building will require further relief from the ZBA as only 5 were
allowed in the original decision.
Zoning bylaw section 301.4.6 indicates that one tree for every 8 spaces. Please confirm that there are 9 in lot trees or
seek relief for the insufficient number of in lot trees.
The decision included the allowance for the installation of a generator and a 100 gallon fuel cell. The increase in number
, of generators and amount of fuel storage will require further relief from the ZBA.
Improvement to the drainage system shall be considered in work areas per 301.4.1 and 406.5.7, paragraph 4.
All generator connections to comply with applicable codes.
pommunity Development and Planning: ZBA Decision 3510, and associated SP-2 Site Plan, showed 5 additional parking
spaces located in front of the building. The current proposed plans are showing 10 new parking spaces in the front of the
building requiring the removal of 10 large trees. As parking in the front of a building is not allowed by the Zoning Bylaw,
any parking in the front yard beyond the original 5 allowed by the ZBA Decision would require relief. If relief is sought,
one of the 10 parking spaces is very oddly positioned (jogged forward with nominal separation from the access drive) and
would recommend the ZBA not approve this space and that this area be planted with a 3"caliper tree. New meter for
charging stations should be fully screened with evergreen shrubs from Old Townhouse Road. Consider different type of
bollards to protect the charging stations that are more aesthetically pleasing than concrete filled metal pipes.
Conservation: There is no jurisdiction under the Wetlands Protection state or local regulations. The Stormwater bylaw
regulations general provisions do not apply. Efforts should be made to ensure there are no illicit discharges (pollutant or
non-stormwater discharge) to the Waters of the Commonwealth (including groundwater) per section 3.03. The property
owner is responsible for ensuring they meet the EPA Multi Sector General Permit requirements.
Design Review: Not present.
jA n•ineerin•: The proposed parallel parking stalls adjacent to the new generator pad must be 10' x 23' in size at a
minimum. In its current state, the on-site stormwater management system does not provide adequate pre-
treatment of runoff prior to direct infiltration. As the applicant is proposing an increase in impervious surface, and
the subject property is located within the Aquifer Protection District (APD), it is recommended that the existing
system be brought into compliance with the standards outlined within Section 406.5.7, paragraph 4, of the Town
of Yarmouth Zoning Bylaw, while utilizing the stormwater management standards and recommended Best
Management Practices (BMPs) contained within the Massachusetts Stormwater Handbook.

GLHealth: The project must comply with all aspects of the Town of Yarmouth Board of Health Hazardous Materials
Regulation: Handling and Storage of Toxic or Hazardous Materials.
A Board of Health (BOH) Hearing is required prior to the Zoning Board of Appeals Hearing.
Submittals from Comcast to the Board of Health must include: a project narrative, a site plan (the plan copies
submitted for Site Plan Review are suitable for this purpose), an interior floor plan, an emergency spill response
plan, and storage tank fueling plan (again the plans submitted for Site Plan Review are suitable for this purpose).
