(BSC) is pleased to submit this Notice of Intent (NOI) Application on behalf of Thomas A. Grimes (the Applicant) for the property located at 10 Surfside Terrace, South Yarmouth, Massachusetts (the Site). The proposed project involves the relocation of an existing boathouse approximately 25 feet landward, along with the construction of a narrow, raised deck around the relocated boathouse to be used as access for both entrance doors. The existing pervious patio abutting the current location of the boathouse will be reconfigured and reduced in size, adjacent to which a 560-square foot native planting area is proposed. A small bathroom addition, roughly 5’ x 8’ in size is also proposed in association with the existing single-family dwelling. For more information, please refer to the attached Site Plans and Project Description. Applications must be submitted two weeks prior to the next scheduled Conservation Commission meeting. No new information may be accepted into the Commissioner’s packet a week before the meeting. Failure to follow the Administrative Checklist guidelines shall result in an Administrative Incomplete Application and will not be advertised for a Public Hearing. Project Description Notice of Intent 10 Surfside Terrace South Yarmouth, MA 02664 PROJECT DESCRIPTION 1.0 INTRODUCTION The proposed project at 10 Surfside Terrace in South Yarmouth (the Site) involves the relocation of an existing boathouse approximately 25 feet landward, along with the construction of a narrow, raised deck around the relocated boathouse to be used as access for both entrances. In addition, the existing pervious patio abutting the current location of the boathouse will be reconfigured and reduced in size, adjacent to which a 560-square foot (sf) native planting area is proposed. A small bathroom addition, roughly 5’ x 8’ in size, is also proposed in association with the existing single- family dwelling. Please refer to the attached Site Plan for additional information. This application is being submitted in accordance with the Massachusetts Wetlands Protection Act and the Town of Yarmouth Wetlands Protection By-law. 2.0 SITE DESCRIPTION The property located at 10 Surfside Terrace, contains a single-family home, lawn, boat house, wooden bulkhead, and a pier with a seasonal ramp and float. The property is abutted by single- family homes to the north, west, and east. The southern edge of the property is abutted by the Bass River. The wetland resource areas and areas of conservation jurisdiction on or adjacent to the site, that are protected under the Wetlands Protection Act and the Town of Yarmouth Wetland Protection Bylaw include:  Land Under Ocean  Riverfront Area (RFA)  Coastal Beach  Coastal Bank  Land Subject to Coastal Storm Flowage (Zone AE, El. 12) 3.0 PROPOSED ACTIVITIES The purpose of this application is to authorize the following proposed activities: Relocation of the Existing Boat House: The existing boat house, which is currently located in the southeastern corner of the property immediately north of a wood bulkhead above the Bass River, will be relocated roughly 25’ landward of the Bass River in an area that is currently maintained lawn. A new foundation will be required because the existing foundation of the boathouse has become damaged. The existing boat house will be lifted via jacks and crane and moved on top of the new foundation once it is complete The existing boathouse is within the 0-35’ Buffer Zone to Coastal Beach, RFA associated with the Bass River, and within Coastal Bank. Moving the boathouse landward to the proposed location will provide a significant benefit to the Resource Areas, as well as public safety. These benefits will be the result of removing a structure from the edge of the Bass River and bringing the boathouse into stormwater compliance, thus reducing the risk of damage to surrounding resource areas and other structures on neighboring properties during a storm event. Pervious Patio: A portion of the area where the existing boathouse and an associated patio are currently located, a rounded pervious patio of roughly 184 sf will be constructed. This patio will be located on land which is currently houses a portion of the boathouse, pervious patio, and lawn. Bathroom Addition: A small bathroom addition, roughly 5’ x 8’ in size is also proposed in association with the existing single-family dwelling. This addition will be constructed over existing lawn area, thus not increasing the amount of disturbed area within the RFA. The addition will be outside of Coastal Bank and FEMA Floodzone. 4.0 ALTERNATIVE ANALYSIS No-Change Scenario In this scenario, the project would not go forward. The boat house would remain in the same location and stay on top of the damaged foundation. Continued use of the boat house would not be safe, as the integrity of the foundation is compromised. The current structure sits within Land Subject to Coastal Storm Flowage, Coastal Bank, and is at the edge of the Bass River, making it susceptible to storm damage and having the potential to damage adjacent structures if it were to be impacted during a storm event. Repair Foundation in Place In this scenario, the existing boat house would not be relocated ~25’ back from the Bass River. The boat house would be lifted via jacks and the foundation would be rebuilt in the same place. However, due to current regulations, the first floor of any new building must be at least 1’ above the base flood elevation. Since the boat house is located within Land Subject to Coastal Storm Flowage, Zone AE (Elevation 12’), and the current ground elevation of this area is roughly 4’, this would require the foundation to be elevated roughly 9’above its current elevation. Otherwise major regrading would be necessary. Either of these two options would not reduce the environmental impact of this structure and would also making the new boat house an eyesore for all neighbors and anyone using the Bass River Proposed Scenario The proposed project consists of the relocation of the existing boat house roughly 25’ back from its current location, where it is directly abutting the Bass River. This relocation will significantly reduce environmental impacts through the removal of a structure from the edge of Coastal Beach, Riverfront Area, and Coastal Bank. This will relieve pressure from the bank of the Bass River and greatly reduce the risk of damage to adjacent Resource Areas and neighboring properties due to flooding or erosion. The ground elevation of the proposed boathouse relocation is between 7-10’, compared to roughly 4’ where it is currently located. Therefore, the foundation will require less of a rise to be compliant with stormwater regulations, and will look more aesthetic. Additionally, the planting of a vegetated native buffer strip along the bulkhead will serve as a betterment to the surrounding Resource Areas, as will of the replacement of existing structure with a pervious surface. 5.0 MITIGATION A silt fence and/or straw wattles will be placed at the limit of work seaward of the existing boat house. Roll-off containers will be located within the existing driveway and used to remove all debris from the Site. Any debris getting into the wetland will be removed by hand as soon as possible. All construction will be completed upland of the resource areas except for Riverfront Area, and Land Subject to Coastal Storm Flowage and caution will be taken to ensure Notice of Intent 10 Surfside Terrace South Yarmouth, MA 02664 construction byproducts do not enter the resource area. There is no major grading or vegetation removal associated with this project that will significantly alter the effects of storm surge in the area. A roughly 560 sf area currently within the footprint of the existing location of the boathouse and boathouse deck will be converted to a native planting area at a 2:1 ratio to act as a vegetated buffer strip. The proposed mitigation area will consist of American Beachgrass (Ammophila breviligulata) and Bearberry (Arctostaphylos uva-ursi). The proposed mitigation area will reduce overall impacts to the 0-100-foot RFA on Site by 409 sf. No increase to impacts within 100-200- foot RFA are being proposed.
