All applications must be submitted two weeks prior to the next scheduled Conservation Commission meeting. No new information may be accepted into the Commissioner’s packet a week before the meeting. Failure to follow the Administrative Checklist guidelines shall result in an Administrative Incomplete Application and will not be advertised for a Public Hearing. The ponded area is likely unable to drain properly due to a clogged drain which has not been properly maintained. The majority of vegetation of the site in composed of invasive or upland species. Additionally, the ponded area only appears to hold a few inches of water for a short period of time and is not flooded year-round. Identify provisions of the Wetlands Protection Act or regulations which may exempt the applicant from having to file a Notice of Intent for all or part of the described work (use additional paper, if necessary). The resource area on-site has been classified as an Isolated Land Subject to Flooding, due to the lack of connection to other resource areas on or off site, as noted by field investigations. It must also be noted that this ponded area is likley part of a manmade stormwater system to control stormwater within the area. Clearing the culvert and inlet pipe will serve to restore the landscape on site to its natural state. No significant detriment to wildlife habitat or floodstorage capacity will likley result from this work, especially given that much of the vegeation on site is composed of upland and invasive species. 3. a. Project Description Request for Determination of Applicability 38 Willow Street Yarmouth Port, Massachusetts PROJECT DESCRIPTION 1.0 INTRODUCTION The proposed project located at 38 Willow Street (the Site) in Yarmouth Port, MA involves the location of the culvert on the northwestern property edge, which is likely blocked due to years of forgone maintenance. The culvert, pipe inlet, and other stormwater collection features will be cleared of debris to allow the ponded area, located at a higher elevation than the blocked culvert, to properly drain. This application is being submitted in accordance with the Massachusetts Wetlands Protection Act and the Town of Yarmouth Wetlands Protection By-law. 2.0 SITE DESCRIPTION The property located at 38 Willow Street contains an undeveloped lot which is currently forested, with a low laying area containing standing water. The ponded area is likely unable to drain properly due to a clogged drain which has not been properly maintained. The property is abutted by residential properties and by Sleeping Dog Path to the South. There is only one potential access route, which originates from Willow Street. The wetland resource areas and areas of conservation jurisdiction on the site that are protected under the Wetlands Protection Act and the Town of Yarmouth’s Wetland Protection Bylaw include only Isolated Land Subject to Flooding (ILSF). BSC conducted both a Desktop Analysis (using MassGIS datalayers and other available mapping) and wetlands were delineated in accordance with the methodology described in the Massachusetts Department of Environmental Protection’s (MassDEP) Handbook on Delineating Bordering Vegetated Wetlands (Published in March 1995). The limits of the ILSF were flagged based on the maximum water holding potential of the basin. The vegetation surrounding the edges of the basin is largely comprised of Blackberry (Rubus allegheniensis), Multiflora Rose (Rosa multiflora), Green Brier (Smilax glauca), Fox Grape (Vitis labrusca), and Jewel Weed (Impateins capensis). The delineation was conducted after a significant rain event on 8/29/2019 by BSC Group, Inc (BSC). Prior to this delineation, reconnaissance was conducted along the hydrologic connection shown to cross Willow Street and continue northeast. This exploratory field work was conducted at the suggestion of DEP after it was revealed that the ponded area associated with the ILSF was 2-3 higher in elevation than the culvert and drainage channel at the northwestern edge of the property. The hydrologic connection was followed for 500 feet towards Route 6A (Main Street), with investigative soil pits and vegetation data collected roughly every 20 feet. No jurisdictional resource area was visible at the end of the investigation area. The hydrologic connection appears to be a man-made channel connected by various roadway and driveway culverts to manage stormwater within the area. The majority of the surrounding area is dominated by invasive species such as Norway Maple (Acer platanoides), Black Locust (Robinia pseudoacacia), Morrow’s Honeysuckle (Lonicera morowii), Multiflora Rose (Rosa multiflora), Japanese Barberry (Berberis thunbergii), and the non-native species English Ivy (Hedera helix). This indicated strongly that the ILSF located at the Site is not directly connected to another jurisdictional resource area. Request for Determination of Applicability 38 Willow Street Yarmouth Port, Massachusetts 3.0 PROPOSED ACTIVITIES The purpose of this application is to authorize the following activities: Stormwater Feature Maintenance: The proposed project involves the location of the culvert on the northwestern property edge which will then be cleared of debris. The pipe which runs beneath Willow Street will also be inspected to ensure it has not been blocked. Any additional debris and blockages found within the existing stormwater channel will be removed to allow the ponded area to properly drain downhill. All work will be completed upland of ILSF and caution will be taken to ensure that no debris or other materials byproducts enter the resource area.
