The requirements under table 203.5 of the Town of Yarmouth Zoning Bylaws allow for the following exceptions; 203.5 Table of Dimensional Requirements: Notes: D-2. Cornices, window sills, belt courses and other ornamental features may project not more than eighteen (18) inches; bay/bow windows, greenhouse windows and eaves may project not more than twenty-four(24)inches, and chimneys may not project more than thirty-two (32) inches into any required yard. The certified as-built plot plan shows that the chimney is within the allowed thirty-two (32) inches per the above referenced section of the Town of Yarmouth Zoning Bylaw. It appears that this newly constructed single family dwelling complies with all Town of Yarmouth Zoning Bylaws, and no enforcement is necessary. You have the right to appeal this decision with the Zoning Board of Appeals within 30 days of this letter as allowed by MGL Ch 40a §7 & §15.
