Yarmouth Name of Owner: Christopher Hatch Violation: Failure to Obtain Building Permits for a Shed& Swimming Pool Violation Date: August 8, 2019 Violation Details 1. Failure to obtain a Building Permit for a shed. Re: 780CMR, State Building Code, Section 105—Permits. Sheds up to a maximum of 200 square feet are exempt from this provision. However, as stated in my August 20, 2019 letter, zoning compliance is mandated. 2. Failure to obtain a Building Permit for an on ground swimming pool,formerly known as an above ground pool. Re: 780CMR, State Building Code, Section 105 and International Swimming Pool and Spa Code, Section(A)105—Permits. Accordingly,you are hereby ordered to remove the shed and the pool within fifteen days or obtain a Building Permit for both structures. Failure to do so will result in appropriate enforcement action pursuant to 780CMR.Section 114-Violations,which will include the issuance of Building Code Tickets with fines that range from$100 for the first offence,$500 for the second offence and $1,000for the third and subsequent offences,as prescribed by MGL Chapter 148A and 780CMR. I consider subsequent offences as being failure to comply within fifteen (15)days between ticket issuances. Finally,I made a sincere attempt to work with you by providing verbal and document information. I also provided you with a copy of your plot plan I obtained from the Health Dept.and offered to assist you in plotting the shed and the pool on the plan. However,you failed to respond. As a result,this Violation Notice is now being issued. It is imperative you comply within fifteen(15) days of this order. So ordered, James D.
