Dear Ms.Ray:
This is to serve as a follow up to an inspection performed by Inspector Kevin Hook and myself of the un-occupied single
family house at 195 North Main Street South Yarmouth,on June 27,2019.
During that inspection I observed the following:
-The house is abandoned.
-Some of the windows were open.
-While standing near one of the open windows I experienced,what I would describe,as lung irritation from the mold odor,
emanating from the house.
During our on-site discussion you had stated your mother had occupied the house and was transported by ambulance from
the house because of mold related health issues. This combined with the fact the house has not been occupied since,it would
appear there is a serious mold issue. In addition,you had expressed the desire to demolish the structure and re-construct a
new house. In that vein,contained herein are the Town of Yarmouth Zoning Bylaw provisions for doing so.
-Section 104.3.3—Restoration--While this provision permits a structure to be re-built within its existing"size,character and
setbacks"after damage by"fire,storm,or similar disaster",it may be possible that a house that is effectively destroyed by
mold,may qualify for this exception. This would have to be accomplished within two(2)years of an official determination
by a qualified licensed mold company.
-Section 104.3.2,Para. 1 B.provides that a single family house may be"razed and replaced by right,providing the proposed
new house meets current minimum setbacks,height and lot coverage.
The property in question lies within the R-40 Zoning District with minimum setbacks of:
*Front-30 feet
*Sides&Rear-20 feet
Maximum lot coverage is 25%
Maximum height is 35 feet.
-Section 104.3.2,Para.2 provides that a single family house that cannot meet these standards would require a Special Permit
from the Zoning Board of Appeals.

NOTICE OF UNSAFE STRUCTURE OR PARTS THEREOF

Dear Ms. Amrock:
As a result of an inspection performed by me on January 25,2011,at the above referenced property,the
following Massachusetts Building Code (780 CMR)violations were observed:
The primary structure is open to weather and intruders.
780 CMR 5121.2 Inspection: The building official immediately upon being informed by report or
otherwise that a building or other structure or anything attached thereto or connected therewith is
dangerous to life or limb or that any building in that town is unused, uninhabited or abandoned, and
open to the weather, shall inspect the same; and he shall forthwith in writing notify the owner to
remove it or make it safe if it appears to him to be dangerous, or to make it secure if it is unused,
uninhabited or abandoned and open to the weather. If it appears that such building or structure would
be especially unsafe in case of fire, it shall be deemed dangerous within the meaning hereof and the
building official may affix in a conspicuous place upon its exterior walls a notice of its dangerous
condition, which shall not be removed or defaced without authority from him.
Because these violations are dangerous to life or limb, you are hereby ordered pursuant to CMR 780
Section 5121, and MGL Chapter 143, to remove and/or make safe the aforementioned deficiencies
immediately.
Failure to comply with this order may result in appropriate legal enforcement action. Section 118.4 of the
State Building Code provides for a one thousand($1,000)dollar a day fine for each offense. Each day
constitutes a separate offense.
Finally, you must obtain all necessary permits prior to performing these corrections and notify the
department upon completion.
