It has been brought to our attention,that your project as submitted per the Old King's Highway Certificate of Appropriateness#16-A080 and approved on August 22, 2016, was completed with deviations from the approved elevation plans without prior notification to the OKH Committee. The Statement of Understanding you signed at this hearing, states in part: "All changes to previously OKH approved plans require notification to and approval from the local OKH Committee--before incorporating the change into the project." Failure to comply with the terms of this agreement is a direct violation of the Old King's Highway Regional Historic District Act. It has been determined that you have deviated from this agreement and are therefore in violation of the OKHRHD Act. To avoid further action, you are required to immediately file a new Application for a Certificate of Appropriateness including as built elevation drawings for placement on an OKH Committee meeting agenda. The filing deadlines for the next two meetings are as follows: Filing Deadline Meeting Date Aug 7, 2019 Aug 26, 2019 Aug 21,2019 Sep 9, 2019 Please note: 1)Application fee is doubled if work has been started and/or completed prior to approval. 2) Failure to comply with the OKH Regional Historic District Act is subject to fines and penalties as allowed per Section 12 of the Act. Yarmouth rf- Violation: Occupying a single family house without a Certificate of Occupancy Re: 780CMR,Chapter 1,Section R111.1,as amended—Use and Occupancy,which provides that "No building or structure shall be used or occupied—until the Building Commissioner has issued a Certificate of Occupancy." Re: 780CMR, Section 114.1, as amended—Unlawful Acts, which provides that "It shall be unlawful for any person, or corporation to—occupy a building or structure in violation of the provisions of 780CMR." This department's records show that no Certificate of Occupancy has been issued for the house located at 22 Mayflower Terrence permitted under Building Permit No. BLD-17-002394, dated November 3, 2016, which is currently occupied. Our records reflect the last inspection was performed on March 9, 2018, for insulation. Accordingly,you are hereby ordered to initiate the process of obtaining this Certificate by contacting this office and arranging for a final inspection. In addition,because there appears to be deviations from the proposed front building elevation, shown on the plan dated August 16,2016, submitted to the Old Kings Highway Historic District Committee and what has been constructed,you are required to file a new Application for Certificate of Appropriateness and arrange for a hearing before the Committee. Minor changes include alterations that can be done without a detrimental impact on the overall appearance of the project such as altering a single window or door change or a minor change of colors. All minor changes by amendment will require the local Committee's or its designee's approval. All changes to previously OKH approved plans require notification to and approval from the local OKH Committee. Change requests must be submitted to the Committee in writing on the appropriate request form, which may be obtained from the OKH office. All change approvals must be obtained before incorporating the change into the project. If the change has been implemented prior to receipt of OKH approval, a Minor Change approval or Certificate of Appropriateness application for the revised plans is still required and will result in a doubled filing fee for the appropriate category of work. Failure to comply with the above statements will result in the Building Department issuing a stop-work order or delaying issuance of an Occupancy Permit or final inspection approval.
