However, this is also Riverfront Area. Under those regs, proposed work must be an improvement over existing conditions and proposed work shall not be located closer to the river than existing conditions or 100 feet, whichever is less. The regulations do allow for mitigation. Call the sender to verify if unsure. Otherwise delete this email. Kelly, Hi! We met briefly last summer re two properties. I’m writing with regard to 27 Aunt Edith’s Road, S. Yarmouth. Property sits on the Bass River. We are going to be proposing additional landscaping in the back/riverfront of the parcel. I reviewed Yarmouth’s Wetlands Bylaws but couldn’t find what your setbacks were for STRUCTURES. Our clients property sits entirely in the buffer to the Bass River, and we’re proposing a pergola off of the back of the house. Inspectional Services confirms a pergola is a structure in Yarmouth. The client’s rear property line at the Aunt Edith’s Road end of the property is actually just inside of the top of bank. 1 Zoning setback is 20’ and certainly we’re outside of that, but what is conservation setback for structures?
