Dear Ms. Lopes:
This is to serve as a follow up to my October 4,2018 site visit in response to a complaint this department received,alleging
you are operating a child day care service. The following issues were discussed.detennined and observed:
-You are in fact operating a child day care service.
-You have been issued a license by the Commonwealth of Massachusetts,Mass.Board of Early Education and Care,number
9033193,issued June 7,2018. This license was viewed by me on this date.
-You advised me that Cape Cod Child Development refers the children to you.
-When I advised you the Town ofYarmouth.requires a Special Permit for this type of service/use,Family Day Care Home,
you stated that Cape Cod Development had not advised you of that requirement.
RELEVANT ZONING REQUIRMENTS
-Town of Yarmouth Zoning Bylaw Use Regulation Table 202.5,requires that a Special Permit be issued by the Zoning Board
of Appeals for a Family Day Care Home Use,operated in a Residential Zone,identified as Use P7A. (copy enclosed and.
highlighted)
-25 Pawkannawkut Drive is located in an R-25 Residential Zoning District.
-Zoning Bylaw Section 500.Definitions,defines Family Day Care Home as"A private residence which on a regular basis
receives for temporary custody and care during part of all or the day, children under 7 years of age, or children under 16
years of age if those children have special needs and receives for temporary custody and care for a limited number of hours
children of school age under regulations adopted by the Mass.Board of Early Education and Care." A copy of the complete
text is enclosed.
Accordingly, you are hereby ordered to file the appropriate application, petitioning the Zoning Board of Appeals for the
Special Permit cited above. A copy of this application may be obtained on line,via the Town of Yarmouth web site,or you
may obtain one from the Board of Appeals office,at Town Hall. Ms.Sandi Clark can assist you with any questions you may
have concerning this process.
Finally,it is imperative you commence this process immediately. Failure to do so will constitute a zoning violation and will
result appropriate enforcement action and notification to the Board of Early Education and Care.

Now come the parties and hereby move and request that this matter be remanded to the
Yarmouth Zoning Board of Appeals(the"Board")on terms consistent with this Joint Motion and
the accompanying Order for Remand. As grounds,the parties assert as follows:
1. This is an action brought pursuant to G.L. c. 40A, § 17, arising from the Board's denial of
a special permit requested by the Plaintiff for an existing Family Child Care Home;a use which
requires a special permit from the Board of Appeals in an"R-25"Residential Zoning District;
2. A primary issue in this case involves the Board's concerns regarding appropriateness of
the use within this particular neighborhood;
3. Since the inception of the above-captioned action,the parties have discussed and identified
additional issues, both legal and factual, which were not previously addressed by the Plaintiff
or the Board. These discussions have resulted in an agreement that those additional matters
warrant further hearing by the Board.
WHEREFORE, for the foregoing reasons, and in accordance with the proposed Order for
Remand submitted herewith, the parties respectfully request that this matter be remanded to the
Board for a new public hearing on the Plaintiffs application,as agreed to by the parties.

Pursuant to the Court's approval of the parties Joint Motion for Remand, the Court
hereby enters the following Order for Remand:
1. Within forty-five(45)days from the entry of this Order,the Yarmouth Zoning Board of
Appeals(the"Board") shall commence a duly noticed and published public hearing on the
Plaintiff's application for special permit. The hearing shall be in accordance with G.L.c.
40A and the Yarmouth Zoning Bylaws and the Board's decision upon remand shall
supersede and replace its prior decision subject to Paragraphs 3 and 4 below. The Plaintiff
shall bear the cost of notification and publication;
2. No later than fourteen(14)days prior to the commencement of such hearing,the Plaintiff
shall provide the Board with detailed plans depicting any proposed modifications to the use
and/or any details, submissions,or other matters she wishes the Board to consider;
3. Within twenty(20)days of the filing of the written remand decision with the Town Clerk,
the Plaintiff shall notify the Court accordingly as follows:
a. If the Board's decision upon remand is acceptable to the Plaintiff,that this matter
shall be dismissed;

b. If the Board's decision is deemed unacceptable to the Plaintiff,the Plaintiff may
file an amended Complaint with notice and a copy of the decision on remand, in
which case the instant litigation shall proceed in the regular course;
c. If the Plaintiff does not notify the Court within said twenty (20)days,this matter
shall be dismissed by the Court.
4. The Court shall retain jurisdiction of this matter unless it is otherwise disposed of under
Paragraph 3.
5. Any party not already appearing in this action,may also appeal the Board's decision
upon remand by filing a Complaint in accordance with G.L. c 40A but any such appeal
shall not alter the Plaintiff's obligations under Paragraph 3.

This complaint was filed eaLlier this yeat (April/May)
via a letter to Selectman Mark Forest and the situation seemed to have
been resolved but, unfortunatelyuits back. I thought the regulations
regarding child care were stringent and strictly enforced so when a day
care appeared to be operating at the above address (which is strictly
residential) T complained_ T do not want a day narP in my immg-liatP area.
It stopped, but is now up and running with cars coming and unloading
children (7:45-8:30) , and being picked up in the afternoon (4;-5;00) .

' ENVIRONMENTAL ASSESSMENT (EA) —An EA is the document required by the Federal
Communications Commission (FCC) and the National Environmental Policy Act (NEPA) when
a personal wireless service facility is placed in certain designated areas.
EQUIPMENT SHELTER —An enclosed structure, cabinet, shed or box at the base of the
mount within which are housed batteries and electrical equipment.
EXTENDED STAY HOTEL - Anybuildingor groupof buildings that contain six (6) or more

guest rooms intended to be occupied on a transient basis having one or more rooms including
separate bathroom, kitchen, living and sleeping areas in each unit. All guest rooms in an
Extended Stay Hotel shall meet the operational standards established in section 404.3.8
(Operational Standards for Extended Stay Hotels). The definition of extended stay hotel shall
not include dwelling units and are not meant for permanent occupancy, with the exception of
On-Site Property Managers at Extended Stay Hotels.
FAA— Shall mean the Federal Aviation Administration.
FALL ZONE — The area on the ground within a prescribed radius from the base of a tower.
The fall zone is the area within which there is a potential hazard from falling debris (such as
ice) or collapsing material.
FAMILY—An individual or two (2) or more persons related by blood or marriage, or a group of
not more than five (5) persons not so related, living together as a single housekeeping unit.
DAB' ; — A private residence which, on a regular basis, receives for
temporary custody and care during part or all of the day, children under 7 years of age, or
children under 16 years of age if those children have special needs, and receives for temporary
custody and care for a limited number of hours children of school age under regulations adopted
by the Massachusetts Board of Early Education and Care. The total number of children under
16 in a family day care home shall not exceed 6, including participating children living in the
residence. Family day care home shall not mean a private residence used for an informal
cooperative arrangement among neighbors or relatives, or the occasional care of children with
or without compensation.
FAMILY-RELATED ACCESSORY APARTMENT— a secondary, separate housekeeping unit
of limited size, with its own sleeping, cooking and sanitary facilities, which is located within,
attached to, or adjacent to a primary single-family dwelling unit.
FARMERS' MARKET — a predominantly local fresh food and produce market that operates
regularly at a public location which provides a suitable environment for local farmers and food
producers to sell their locally grown farm origin product and their associated value added locally
made primary products directly to customers.
FCC — Shall mean the Federal Communications Commission.
FLICKER EFFECT—The apparent reflection or shadow visual impact of the moving turbine
blade when a wind turbine is operating.

201.6 B2. In a B2 District the rear boundary line shall be the existing rear boundary lot line as
of June 24, 1971 not to exceed, however, one thousand two hundred (1,200) feet in depth.
201.7 Rear Boundary Lot Line. The "rear boundary lot line," for purposes of district definition, is
defined as that boundary line of a lot shown on a plan of land or described by deed, recorded
with the Barnstable County Registry of Deeds, which is opposite the street line of Route 28.
201.8 Lots in Two Districts. Where a district boundary line divides a lot in existence at the time
lass
such line is adopted, the regulations for the less restricted portion of such lot shall extend not
more than thirty (30) feet into the more restricted portion, provided that the lot has frontage on a
street in the less restricted district.
202 USE REGULATIONS.
202.1 Application. No building or structure shall be erected and no premises shall be used,
except as set forth in the Use Regulations Schedule, or in other sections of this bylaw. If a use
is not specifically allowed, by right or special permit, it shall be considered to be not allowed
unless an appeal is taken under section 102.2.3 and it is shown beyond a reasonable doubt to
be of similar nature and at least no more noxious nor detrimental to the welfare of the
neighborhood than a specifically allowed use.
Other uses specifically prohibited in the Aquifer Protection Overlay District, are listed id Bylaw
section 406.4.1.
The various classes and subclasses of uses listed here come, generally, from the North
American Industry Classification System, as amended. While the manual may be used from
time to time as a guide for clarification, the final application shall be as the "common man" would
interpret these uses in conjunction with the intent below.
202.2 Intent. It is the intent of this section to promote a choice in housing types, including that
for transients and broaden the economic base of the town and create employment while at the
same time protecting the public health by preserving air, water and groundwater quality and
enhancing the public welfare through regulations, or banning land uses which are noisy, dusty,
dirty, smelly, dangerous or otherwise a nuisance to the public at large.
Note: These last, — noisy, etc., statements are to be considered away from the place of activity,
so that, while a bowling alley may be noisy to a bowler, it will not be so to the public driving past.
202.3 More Than One Use. Where a proposed use might be classified under more than one of
the following classes, the more specific classification shall determine permissibility; if equally
specific, the more restrictive shall prevail.
202.4 Symbols. The symbols used in the Use Regulation Schedule shall mean the following:

Dear Ms. Colwell:
I wanted to inform the agency that although the Home Day Care facility, located at 25 Pawkannawkut
Drive South Yarmouth has a License from the Mass. Board of Early Education and Care, it lacks the
required Special Permit from the Town of Yarmouth. Enclosed is a copy of my October 4,2018 letter
to Ms. Gabriela Lopes, operator of this care facility.
As noted, Ms. Lopes stated that she was not advised by Cape Cod Child Development of this
requirement. Based on this, I request that prior to placing children in future locations in Yarmouth,the
Agency advise future care givers that the Town's Zoning Bylaw requires all Family Day Care Home
obtain a Special Permit from the Zoning Board of Appeals.
The agency's cooperation is appreciated and will prevent future cases of this nature.
