Dear Attorney(Jay:
Reference is hereby made to the February 28, 2018 Lot Inquiry submitted for one of ten lots,
identified as Parcel 34 on Assessors Map 64, aka 443 Higgins Crowell Road. This lot was created
along with the other nine lots on an ANR, dated July 16, 1986 and is identified as Lot 6. The plan
depicts the lot contains 40,857 square feet of land area and 50 feet of frontage.
Upon review I have determined the following:
-When the lot was created it was located in the R-40 Zoning District, requiring a minimum of
40,000 square feet of land area and 150 feet of frontage. 'l'hose minimums remain in effect today.
-When created, Zoning Bylaw Table 203.5 Dimensional Requirements, Footnote N required that
"At least ninety(90%) of the minimum lot size required be upland (i.e., not a back, beach, bog,
dune, marsh, swamp or wet meadow under MGI.:Chapter 131, Section 40)." The existing Zoning
Bylaw requires one-hundred per cent.
- Zoning Bylaw Section 203.2, Minimum Frontage Reduction provides that the frontage may be
reduced to 50 feet providing the "lot is capable of containing a square each side of which is equal
to the minimum frontage, normally required in that district(1.50). The width of an y lot, between
the street lines and the proposed building setback line, shall be no less than twenty (20)feet."
This Section also provides that "no point along any side of the above requisite square shall exceed
a distance from the street greater than 500 feet in the R-40 Zoning District."
Because the lot in question was created via an ANR and not a Definitive Subdivision Plan, these
requirements were not specifically depicted. Based on the raw dimensions, it appears the square of
150 would comply. However, in order to make a definitive determination that the lot is compliant
with the aforementioned provisions, a Certified Plan, stamped by a Land Surveyor, shall be
provided.
Finally, as per your discussion with Building Commissioner Mark Grylls, should you desire to seek
determinations on the remaining nine lots, you must submit separate Lot Inquiries for each. A fee of
$90 is required for each. These inquires shall also include the depictions of the aforementioned
frontage requirements and unless the upland area is defined, only a provisional zoning determination
can be made.

Dear Building Commissioner Grylls:
Enclosed you will find an Application for Lot Inquiry Form together with the $90 fee on this
application. The application cers Lot No.6434,but I have included all of the lots on the application form
so you have a complete background.
The Diocese of Fall River has owned this property for a number of years and receives ten individual
tax bills every year. Copies of the tax bills are enclosed.
The Diocese would like to place these parcels on the market for sale as lots available for single-
family homes. In preparation for that we obtained an appraisal on the property in November of 2015 and at
that time our appraiser was advised by the Town Planner that the lots appear to be buildable in the R40
zoning district(assuming there are not wetlands on the properties). To the best of our knowledge,there are
no wetlands. The reduced frontage is allowed,as we understand it,pursuant to Section 203.2.1 of the Town
of Yarmouth Zoning By-Law. Likewise, the minimum shape factor does not apply as the lots were in
existence prior to October 5,2005.
In marketing the property,we want to be totally transparent with any potential buyer;and,therefore,
we are asking for this determination on the buildability of the lots for single-family residential purposes.

; I have taken a look at the 10 lots off Higgins Crowell shown as Assessor Map/Parcels 64.30 thru 64.35 and 74.1
l thru 74.4. These lots were created through an ANR (#2715) on July 16, 1986 and recorded at the registry of
deeds Plan Book 420/Page 59.
These 10 vacant lots meet the current dimensional requirements for the R40 Zoning District for area (assuming
there are no wetlands on the properties)and frontage(including using the reduced frontage al owed under
Section 203.2.1 of the Zoning Bylaw). Although the lots may not meet the Maximum Shape Factor identified in
ilj# Table''203.5,Note V indicates that lots in existence before October 5, 2005 that are not in compliance with the
' Shape Factor shall not be deemed non-conforming by virtue of shape. The zoning bylaw may be viewed on the
Town website at http://www.yarmouth.ma.us/DocumentCenter/View/597
